    Summary: The Care Provider’s contract is not in line with the Competition and Markets Authorities (CMA) guidance about fair contract terms. The Care Provider has agreed to review its contract to ensure it is in line with CMA guidance and to apologise to Mr C for the uncertainty caused by its actions.

    Summary: the complainant complained the Care Provider provided poor quality care for her mother at its Britten Court Lowestoft care home causing distress and risk of harm. The Care Provider says it learned from the complaint by improving staff practice and engaged with the proper agencies to report safeguarding issues. We found following several falls and some incidences of poor care the Care Provider caused injustice for which we have recommended a remedy.

    Summary: The Ombudsman found no fault by the Council on Mrs T’s complaint about her home suffering damage from a bathroom tap left on by a carer who visited the day before. There is no evidence showing the carer was responsible for the flooding. The carer may not have been the last person to go upstairs to the bathroom. There is simply not the evidence to justify a finding of fault against the Council.

    Summary: Mrs X complained about the Council’s failure to carry out a proper care needs assessment and other related issues. We have found the Council was not at fault.

    Summary: Mrs C complains about the way the Council provided information about her son’s care costs before he moved to supported living accommodation. Mrs C says her son faced an unexpected and large increase in his outgoings which caused him significant upset and contributed to a suicide attempt which has caused long-term damage to his health. We have found no evidence of fault by the Council.

    Summary: The Council was at fault for delaying in carrying out an assessment of Mrs Y and for the care she received at the care home. This resulted in it taking longer to establish Mrs Y’s care needs and uncertainty for her family concerning the level of care she received. The Council has agreed to remedy the injustice caused.

    Summary: We will not investigate Mrs B’s complaint about care and support given to her mother, Mrs C. This is because we could not add to the Council’s responses or make a different finding of the kind Mrs B wants. We do not have written consent from Mrs C to consider a complaint from Mrs B on her behalf.

    Summary: We will not investigate the complainant’s concerns about the Council losing his information. This is because it is unlikely an investigation by the Ombudsman could add to the Council’s response. The Complainant can also complain to the Information Commissioner’s Office if he is concerned about how the Council handles his personal data.

    Summary: We will not investigate Mrs B’s late complaint about the way she and her late father, Mr C, were treated by his care provider. This is because any injustice caused to Mr C from the actions of his care provider cannot be remedied now, and, although Mrs B feels she has not received an appropriate remedy for the care provider’s failings, the care provider reimbursed Mr C for care he did not receive in 2019 and Mrs B could have come to us before now if she felt this was not an appropriate remedy. There is no good reason to disapply the law and investigate this late complaint now.
