  • Luton Borough Council (19 004 404)

Statement Upheld Commercial and contracts 25-Feb-2020

Summary: Mr X complained about the Council’s failure to formalise its relationship with his company. He said its failure to do so has caused his company financial and reputational loss. We found the Council took too long to decide Mr X needed to tender for new work. It has apologised which is an appropriate remedy. We will not investigate its actions before 2018 because Mr X could have complained about them to it, and us, sooner.

  • Buckinghamshire County Council (19 015 752)

Statement Closed after initial enquiries Other 24-Feb-2020

Summary: The Ombudsman will not investigate Ms X’s complaint about the Council’s decision not to refund a notice of marriage fee. This is because there is not enough evidence of fault by the Council to warrant an investigation.

  • London Borough of Tower Hamlets (19 016 609)

Statement Closed after initial enquiries Other 24-Feb-2020

Summary: The Ombudsman will not investigate this complaint about the Council’s use of a photograph of the complainant’s late father. This is because the Council has already provided a fair response.

  • Cheshire West & Chester Council (19 018 509)

Statement Closed after initial enquiries Councillor conduct and standards 22-Feb-2020

Summary: The Ombudsman cannot investigate Mr X’s complaint about the way he has been treated in his role as a councillor and how the Council considered his complaint about this. Mr X does not complain as a member of the public and so the complaint is outside the Ombudsman’s legal remit.

  • Copeland Borough Council (19 018 785)

Statement Closed after initial enquiries Councillor conduct and standards 22-Feb-2020

Summary: The Ombudsman cannot investigate Mr X’s complaint about how the Council considered complaints made about his conduct as a councillor. Mr X does not complain as a member of the public and so the complaint is outside the Ombudsman’s legal remit.

  • Birmingham City Council (19 016 686)

Statement Closed after initial enquiries Commercial and contracts 21-Feb-2020

Summary: The Ombudsman will not investigate Mr B’s complaint of discrimination and fraud against his organisation, unfair practices in the Council’s tender procedures and that its staff acted unprofessionally. This is because it was not unreasonable to expect him to go to court to seek a remedy for the financial loss he has claimed.

  • Cornwall Council (19 017 172)

Statement Closed after initial enquiries Councillor conduct and standards 21-Feb-2020

Summary: Mr X is unhappy about the Council’s consideration of his complaint that a member of an inshore fishery authority gave misleading information to the public about threats to the local fish stocks. The Ombudsman cannot investigate, as this impacts all or most of the people in the Council’s area.

  • Bury Metropolitan Borough Council (19 019 247)

Statement Closed after initial enquiries Elections and electoral register 20-Feb-2020

Summary: Mr X complains a letter addressed to his ex-wife, asking her to register to vote, was sent to his new address. The Ombudsman cannot investigate as the organisation of elections is not a Council function.

  • London Borough of Richmond upon Thames (19 009 161)

Statement Upheld Leisure and culture 20-Feb-2020

Summary: Ms D says the Council failed to adequately redress her complaint about a leisure facility. The Council had already accepted fault and offered redress. It has now offered an additional amount of financial redress. As such, the Ombudsman has upheld the complaint and completed the investigation.

  • Welwyn Hatfield Borough Council (19 013 532)

Statement Closed after initial enquiries Other 20-Feb-2020

Summary: The Ombudsman will not investigate the complainant’s concerns about the Council’s handling of his emails and complaints. This is because the underlying matter, which the complainant originally contacted the Council about, does not cause him a significant personal injustice, and his concerns about the Council’s associated complaints process do not warrant investigation in isolation.
