  • East Riding of Yorkshire Council (19 016 634)

Statement Closed after initial enquiries Land 15-Feb-2020

Summary: The Ombudsman will not investigate Ms X’s complaint about encroachment onto her land by a property developer. This is because her complaint concerns a boundary dispute. This is a private civil matter between Ms X and the property developer as the owner of the neighbouring land. It is not for the Council to investigate the property developers actions, and so there is not enough evidence of fault to warrant an investigation.

  • Birmingham City Council (19 017 412)

Statement Closed after initial enquiries Commercial and contracts 14-Feb-2020

Summary: The Ombudsman will not investigate Mr X’s complaint about the Council’s failure to pay his company’s invoices. This is because it would be reasonable for him to take the matter to court.

Statement Closed after initial enquiries Other 13-Feb-2020

  • London Borough of Havering (19 015 684)

Statement Closed after initial enquiries Commercial and contracts 13-Feb-2020

Summary: The Ombudsman will not investigate Mr X’s complaint about the rent amount the Council pays for his property. This is because it is unlikely we would find fault by the Council causing Mr X significant injustice.

  • London Borough of Croydon (19 011 413)

Statement Closed after initial enquiries Land 12-Feb-2020

Summary: This complaint is outside the Ombudsman’s jurisdiction. A judicial review against the Council was commenced on matters complained about, the highway status of a piece of land and its associated rights of way.

  • Torbay Council (19 013 763)

Statement Closed after initial enquiries Other 12-Feb-2020

Summary: The Ombudsman will not investigate Mr B’s complaint about the Council’s involvement in the roll-out of superfast broadband. The Ombudsman could not say the injustice Mr B claims is due to fault by the Council.

  • Broxtowe Borough Council (19 009 445)

Statement Upheld Commercial and contracts 11-Feb-2020

Summary: The Ombudsman found fault by the Council on Mr W’s complaint about its failure to promptly act to resolve the drainage issue affecting the garages he rents from it. It failed to do works it said it would, failed to show evidence of works done, and failed to clear vegetation. The agreed action remedies the injustice caused. It was not fault for the Council to insist he continues to pay the rent he agreed to pay for them.

  • Milton Keynes Council (19 016 257)

Statement Closed after initial enquiries Other 11-Feb-2020

Summary: The Ombudsman will not investigate this complaint about the Council’s failure to consider a complaint made by Mr X about the way the Council treated another member of the public. This is because Mr X has not suffered a personal injustice to warrant our involvement.

Summary: The Ombudsman will not investigate Mr X’s complaint about the Council’s response to his Subject Access Request. This is because the Information Commissioner’s Office is better placed to deal with his concerns.

Statement Closed after initial enquiries Other 10-Feb-2020

Summary: Mr X complained about the Council excluding him from public points of contact on the grounds of unacceptable behaviour. The Ombudsman should not investigate this complaint. This is because there is insufficient evidence of fault which would warrant investigation.
