Summary: Mrs X complained about how the Council handled an alleged breach of planning control. We have found fault with the Council for how it handled the planning application that the enforcement case relates to. This caused Mrs X a loss of amenity that the Council has agreed to remedy.

Summary: We found fault by the Council on Mr H’s complaint about it failing to provide financial support to help him move to accommodation it found him. It failed to show it had proper processes and guidance in place when dealing with obtaining, assessing, deciding, and paying quotes. The agreed action remedies the injustice caused.

Summary: We upheld Mrs X’s complaint about delays in the Education, Health and Care process regarding her child, Y. The Council agreed to resolve this complaint early by providing a proportionate remedy for the injustice caused. We did not investigate Mrs X’s complaints about poor communication because an investigation by the Ombudsman is unlikely to achieve anything further. The Information Commissioner’s Office is better placed to consider Mrs X’s other complaints.

Summary: Miss X complained the Council has failed to provide wraparound or holiday childcare for children with special educational needs in the county. We found evidence of fault by the Council because it failed to make sure it was aware of the childcare needs of parents with children who have special educational needs. The Council agreed to apologise and make a payment in recognition of the injustice caused to her. It also agreed to tell Miss X about the childcare offer it can make to her this summer.

Summary: Ms X complains the Council has failed to meet all her needs for care and support. The Council’s records containing conflicting information about how it has been meeting Ms X’s needs. It has also failed to engage with other agencies which have contacted it on Ms X’s behalf. The Council needs to apologise to Ms X, make a symbolic payment, reassess her needs and update her care and support plan.

Summary: We found fault by the Council on Ms B’s complaint about its refusal to refund money paid to enforcement agents following the revocation of previous Orders for Recovery by the Traffic Enforcement Centre. The agreed action remedies the injustice caused.

Summary: Mr X complained the Council has not taken enforcement action in relation to breaches of planning control at a site near his home. We found some evidence of fault by the Council, but this did not affect its decision not to take formal enforcement action. The Council agreed to apologise to Mr X for the frustration and uncertainty caused by the fault we found.

Summary: Mr and Mrs X complained about the Council’s actions with a safeguarding referral it received about their child. They said it inappropriately acted with prejudice and on an untrue view of their religion. We did not find fault with the Council’s decision making process. We are satisfied with the Council’s apology with some fault it identified, and this is appropriate for the injustice it caused.

Summary: Ms X complained the Council did not deliver suitable alternative education to her son when he was unable to attend mainstream education and that it did not deliver specialist provision outlined in his Education, Health and Care Plan. We found fault because the Council did not act decisively to try and secure alternative education for her son and did not have appropriate oversight of what specialist provision was being delivered to him. To remedy the injustice caused by this fault, the Council has agreed to apologise, make a payment to Ms X, issue reminders to relevant staff and consider reviewing some of its procedures.

Summary: Mrs N complains about the actions of the Council’s Special Educational Needs and Disabilities Team regarding her daughter’s Education, Health and Care Plan. This includes the new placement it proposed for her daughter, the way it arranged transition planning and poor communications. We cannot look at the school named in the Plan, as the Special Educational Needs and Disabilities Tribunal is better suited to look at that issue. But we have upheld some of Mrs N’s complaints; principally about the Council’s lack of oversight of the delivery of the outcomes of the Education, Health and Care Plan and the provision of alternative education for Mrs N’s daughter. The Council has agreed to our recommendations of remedies.
