    Category: Education Date: 09-Aug-2026

    Summary

Ms C complains the Council did not carry out a review of her son’s Education, Health and Care Plan before his move to secondary school. It also further delayed issuing a Plan, did not attend a meeting about their appeal and was poor in its communications. We uphold the complaint because of poor communications by the Council, including not attending meetings. The Council has agreed to our recommendations to remedy the injustice to Ms C and her family.

    Service improvements

The Council will share with the Ombudsman an update on its communications plan/protocol and how learning from this complaint can feed into that plan, including around a process for ensuring parents and young people are promptly advised about staff changes and how communication is not impacted due to staff absence. The Council will remind its staff the Special Educational Needs and Disability Regulations do require a review (including a meeting) within the 12 months before a child moves between phases of education.

  • Surrey County Council (25 011 300)

Category: Adult care services Date: 19-Aug-2026

    Summary

We found there was fault in the way the Council’s Adult Social Care Team considered Y’s need for a residential or supported living placement. We found the errors and delays caused Y to miss out on five weeks of education and caused frustration and distress. We recommended a payment, an apology and review of procedures and training.

    Service improvements

The Head of the Special Educational Needs Department (SEND) and Adult Social Care Department (ASC) should meet to discuss our findings in this case and to review the Council’s documented procedures. The Council should write to us to set out any changes in procedures or additional training that are required to avoid a repetition of the issues we have identified. The Council should also then communicate the correct process to all relevant staff to ensure clarity in such cases in future and provide evidence it has done this.

    Category: Education Date: 07-May-2026

    Summary

Mrs X complained the Council failed to provide her child, Y, with suitable education when they were unable to attend school from April 2024. We find the Council at fault for failing to consider its section 19 duty between September 2024 and February 2026. This caused Y and Mrs X distress, uncertainty and frustration. The Council has agreed to apologise, make a symbolic payment and complete service improvements to remedy the injustice caused.

    Service improvements

The Council will ensure it has a process in place for the team who assess Education, Health and Care needs assessment requests to ensure that cases are raised for review by the Surrey Attendance Service, as soon as possible when evidence suggests a child is not attending school, who will ensure advice is given to schools regarding referral processes and evidence required for LA section 19 consideration.
