    Statement Upheld Transport 01-Apr-2025

Summary: Ms X complained the Council did not deal with her application to renew a blue badge in line with law or government guidance. There was fault causing injustice because the Council did not deal with the application in line with the Equality Act 2010 or with blue badge guidance. This caused avoidable uncertainty and distress about the outcome had the Council considered Ms X’s case properly. The Council will issue an apology, make a small symbolic payment to reflect Ms X’s avoidable distress and reconsider her case.

  • Surrey County Council (24 009 196)

    Statement Upheld Alternative provision 15-Apr-2025

Summary: Mrs X complained that the Council failed to make suitable education provision for Y when the family moved into the area. The Council was at fault as it delayed in making education provision for Y, failed to explain why it considered a school was suitable, delayed in carrying out an annual review of Y’s Education, Health and Care Plan and delayed in issuing an amended Plan. This meant Y missed education provision between March and July 2024 and the faults caused distress to Mrs X. The Council has appropriately remedied the loss of education provision between April and July 2024 but it has agreed to make a symbolic payment of £400 to Mrs X to remedy a further two weeks of missed provision. The Council has also agreed to make a symbolic payment of £500 to Mrs X to acknowledge the distress and uncertainty caused to her by the delay in issuing the amended Education, Health and Care plan and failure to explain why a school was suitable.

  • Surrey County Council (24 012 381)

Statement Upheld Special educational needs 06-May-2025

Summary: Miss X complained the Council delayed issuing an Education, Health and Care Plan after an annual review. And that her child, Y, missed education because of illness. There was a delay of four months in issuing a final Education, Health and Care Plan after the annual review. There was also a failure to adequately monitor Y’s education when they were ill for extended periods of time and not in school. A payment and apology remedies the injustice from the delay and uncertainty to Miss X and Y.

  • Surrey County Council (24 009 517)

Statement Upheld Special educational needs 08-May-2025

Summary: Ms X complained the Council delayed issuing the amended Education, Health and Care Plan following a tribunal decision in May 2023. The amended plan was provided 31 weeks late and the required provision was not put in place until May 2024 and then not all of it. This resulted in Ms X’s son missing out on suitable education and caused distress to them both. A financial remedy for the distress and lost education provision is agreed.

Statement Upheld Assessment and care plan 13-May-2025

Summary: Miss X complained about how the Council managed her care needs after the previous arrangement broke down and it did not provide her with the support or hours she needed. We found the Council at fault for significant delays with a reassessment of her needs and how it decided her care hours. The Council has agreed to apologise to Miss X, make a symbolic payment, and take action to prevent recurrence of fault.

Statement Upheld Special educational needs 27-May-2025

Summary: Miss B complained the Council’s Education, Health and Care Plan process failed her son, X. Miss B says X has been placed in an unsuitable placement and is receiving little to no education. We found the Council at fault for a delay in issuing a final Education, Health and Care Plan following an annual review and failing to consider its section 42 duty once it was aware X was not attending school. This has caused distress, frustration and uncertainty to Miss B and X. The Council has agreed to apologise, make a symbolic payment and complete service improvements to remedy the injustice caused.
