    Summary: Mrs X complained about the delays in the education, health and care plan process. She also complained about the Council’s communication and said her son had been out of education. We find the Council was at fault. This caused significant distress to Mrs X and her son was out of education. The Council has agreed to several recommendations to address this injustice caused by fault.

    Summary: Mr X complained about the process the Council followed when completing the annual review of Ms Y’s Education, Health and Care Plan. We find the Council at fault for missing statutory deadlines and for not keeping Mr X updated throughout the process. The Council has agreed to apologise to Mr X and Ms Y, make a payment to recognise the injustice caused, and act to prevent recurrence.

    Summary: Ms X complained about the Council’s delay in completing her child’s (Y’s) education, health, and care needs assessment and poor communication. We found the Council at fault. It should apologise to Ms X and make payments to her to reflect the uncertainty, frustration and distress caused by the delays.

    Summary: Mrs X complained the Council failed to provide her son who has complex medical needs, with school transport. We have found the Council at fault as it was unable to fulfil its statutory duty to provide Mrs X’s son with transport. This caused Mrs X’s son to miss out on education and accessing his special educational needs provision as well as causing Mrs X and the wider family avoidable distress.

    Summary: There is no fault in the Council’s decisions around funding Y’s night care, the direct payment rate or funding for carers’ training. The Education Health and Care Plan did not include details of the personal budget for Y in Section J and this was fault. The Council will amend the Plan to include the personal budget, apologise for the avoidable confusion and uncertainty and make Ms X a symbolic payment of £100.

    Summary: Mr C complained the Council's occupational therapy service delayed in responding to his requests for a reassessment and initially produced a report which did not adequately describe his needs. Mr C says he has lived in an unsuitable property for longer than necessary which has had a harmful impact on his health. We have found fault by the Council in the time taken to complete a reassessment but consider the agreed action of an apology and symbolic payment provides a suitable remedy.

    Summary: Mrs B says the Council failed to provide education when it knew her son could not return to his allocated school due to medical reasons. I have found no fault in the Council’s decision not to put in place alternative provision. The Council failed to ensure the therapeutic provision the school agreed to put into place was followed up on. An apology, payment to Mrs B and a reminder to officers is satisfactory remedy.

    Summary: We will not investigate Ms X’s complaint about delays in the Education Health and Care Plan process. This is because the Council has agreed to apologise to Ms X and pay her £100 per month for the delay. We consider this an appropriate remedy and further investigation is therefore unlikely to achieve anything more.

    Statement Upheld Alternative provision 30-Apr-2024

    Summary: Mrs X complained about delay in issuing an Education, Health and Care Plan for her son and about the failure to provide a suitable education from February 2022. Mrs X says this caused distress and affected the development of her son’s social and communication skills. The final plan was issued 18 weeks late which is fault and, based on what we currently know, the Council failed in its duty to provide suitable education for one term. A suitable remdey for the injustice caused is agreed.

    Summary: We will not investigate this complaint about the Education Health and Care Plan process. This is because the Council has agreed to an appropriate remedy for the delay. If Miss X wants to challenge the content of her son’s Education Health and Care Plan, then it is reasonable for her to appeal to a tribunal.
