    Summary: Miss X also complained the Council has refused to provide an Education Other Than At School (EOTAS) package for her daughter and is wrongly trying to force her into a school setting. Her daughter has been unable to access education in a school setting for several years and has not received a suitable education.

    Summary: Mr F complained the Council delayed providing his daughter with an assisted listening device. He also says the Council failed to adhere to statutory timescales when dealing with his daughter’s annual review and its communication with him was poor. We find the Council was at fault as it delayed communicating with the school to resolve the issue with the assisted listening device. It also did not adhere to statutory timescales when dealing with Mr F’s daughter’s annual review and it was at fault for its overall communication with Mr F. The Council has agreed to our recommendations to address the injustice caused by fault.

    Summary: Mrs B complained that the Council, in respect of her son C’s special educational needs, had failed to secure occupational therapy and tuition in accordance with his Education, Health and Care Plan. We found fault causing injustice. The Council has agreed to pay Mrs B £1800 for the benefit of C and to continue its efforts to secure the provision.

    Summary: We will not investigate this complaint about a delay in carrying out Ms X’s care needs assessment and arranging an advocate. The Council has apologised, arranged an advocate, and carried out a care assessment. Further investigation by us would be unlikely to add to this or lead to a different outcome.

    Summary: Ms D complained that the Council delayed for over a year in finalising the Education, Health and Care Plan for her child, E and failed to provide E with any education during this period. We found fault with the Council actions. It has agreed to pay £2,400 for another term of missed provision in addition to the £7,650 already offered.

    Summary: Mrs X complains about the Council’s handling of her child’s, Child Y, education. The Council was at fault for not ensuring Child Y received all the provision in their Education, Health and Care (EHC) Plan and associated personal budget from February to October 2022. The Council also delayed or failed to complete EHC Plan annual reviews between 2021 and 2023. The Council has agreed to apologise and make payments to Mrs X and Child Y for the injustice caused by these faults.

    Summary: Mrs X complained that the Council did not complete the review of her child’s education, health and care plan properly or in a timely fashion causing distress, frustration and uncertainty. We found the Council was at fault in failing to comply with statutory timescales. In recognition of the injustice caused the Council has agreed to make a payment to Mrs X.

    Summary: Mrs X complained about the Council’s handling of her request for an Education, Health and Care Plan for her son, and about its handling of her subsequent complaint. Mrs X says the Council’s actions caused avoidable stress to her and her son. We found fault by the Council and the Council has agreed to provide Mrs X with an apology and a financial remedy.

    Summary: Mrs C complained the Council failed to adhere to the statutory timeframes for completing an EHC needs assessment for her son, X. She says X is struggling at school and needs the process completed to ensure they receive appropriate educational support ahead of their GCSE’s. We have found the Council at fault. The Council has agreed to make a payment to remedy the injustice caused by the faults identified.

    Summary: Ms X complained about the Council’s delay when issuing an Education, Health and Care (EHC) Plan, and failure to provide her child with an education when she was unable to attend school due to extreme anxiety. We found fault because the Council took long to issue the EHC Plan. There was also poor communication and complaint handling. To remedy the injustice to Ms X, the Council has agreed to apologise and make a payment to her. We did not find the Council failed to provide an education because Ms X made alternative arrangements herself.
