Summary: There was delay by the Council carrying out an Education, Health and Care needs assessment. The Council remedied this complaint before it was made to the Ombudsman by issuing the plan with the parents preferred school and making a payment. Mr X said the payment was not enough, as it did not cover a terms school fees. As the remedy is greater than in our remedy guidance for loss of education for a term and it is not certain the school would have been named if the delay had not occurred, no additional remedy is recommended.

Summary: We will not investigate Miss X’s complaint about the Council’s financial remedy it paid her in recognition of her child, Y’s, lost education after they were excluded from school in March 2023. This is because the Council’s remedy was in line with the Ombudsman’s Guidance on Remedies and an investigation by the Ombudsman is unlikely to achieve anything further.

Summary: Ms X complained about the Council’s failure to ensure suitable support and accommodation was available when she moved to a different council area in a crisis situation involving her daughter. We found the Council was at fault because it did not make the referral when it said it would. The Council has already apologised, and this is an appropriate remedy for the distress experienced by Ms X. We found no evidence the Council told Ms X to move to the new area.

Summary: We will not investigate this complaint about charging for an adult social care respite stay. The Council told the complainant they may have to pay for the respite stay. So, the Council’s delay in completing the financial assessment does not cause the claimed injustice. The Council has apologised for its delay and said the complainant can pay the debt in instalments. It is unlikely we would achieve anything further.
