    Summary

    there was some fault by the Council in relation to the matters complained about in the form of a failure to update written care plans and delays in the complaints handling process. The Council will take the agreed action to recognise the injustice these caused and to ensure that such faults do not recur

    Service improvements

    To ensure that the delays in the statutory complaint handling identified in this complaint do not occur in the handling of future complaint the Council will provide evidence that it will ensure that it has a process in place which ensures that statutory timescales are met at stage 2 of the complaints procedure.The Council will also provide us with evidence that social work staff are reminded of the need to update care plans if necessary following review meetings or other changes.

    Summary

    Mrs X complained the Council delayed carrying out the annual reviews for her children’s Education, Health and Care plans, and delayed issuing the plans after the reviews were carried out. She also complained the Council did not follow the correct process for a child transitioning to a new setting. Mrs X says this caused avoidable stress to her and meant her children were left with outdated plans. We have found fault by the Council and the Council has agreed a remedy to address the injustice caused.

    •Carry out an audit of current EHC plans managed by the Statutory Review and Assessment Team to identify any other cases where there have been delays in the review process within the last 12 months•Produce an action plan to provide appropriate remedies to the cases identified where there has been delay•Carry out a review of its processes to ensure it is carrying out annual reviews, issuing decision notices and finalising amended EHC plans in line with the statutory guidelines

    Summary

    Mrs X complained the Council delayed issuing an Education, Health and Care Plan for her child, and delayed making provision to meet their special educational needs. Mrs X says this resulted in a loss of education for her child and uncertainty and distress to the family. We have found fault by the Council and the Council has agreed a remedy to address the injustice caused.

    Summary

    There was fault by the Council in failing to put in place suitable full-time education when Y was unable to attend school due to bullying and anxiety. There was also fault in the Education, Health and Care (EHC) needs assessment and delay in issuing an EHC plan. This caused Y to miss out on full-time education for a period of eighteen months. Recommendations for an apology, financial remedy payment and service improvements are made.

    The Council will review its procedures for children who are out of education to ensure children are tracked until back in full-time education and it communicates effectively with families.The Council will review its processes for Education, Health and Care needs assessments to ensure correct advice is sought and discussed with parents.
