    Summary: Mr Y complained the Council failed to meet his brother Mr X’s needs due to the inadequacy of his current supported living accommodation and it failed to deal with the disruptive behaviour of another tenant. Any concerns Mr Y has about the current accommodation are matters for the housing association and are outside the Ombudsman’s jurisdiction. The Council is not at fault for the way it is meeting Mr X’s needs. It has taken action to address the concerns about the other tenant’s behaviour and is not at fault. It is at fault for failing to review Mr X’s care plan. It has agreed to do so now.

    Summary: Mr X complains the Council refuses to resurface his road which he says needs repair. The Ombudsman will not investigate this complaint. It is reasonable to expect Mr X to use his right to go to court to require the Council to repair the road.

    Summary: The Ombudsman will not investigate this complaint that the Council pruned a hedge at the back of the complainant’s property without giving him an opportunity to do the work. This is because there is insufficient evidence of fault by the Council and insufficient evidence of injustice.

    Summary: A man complained that the Council unfairly reduced his priority on its Housing Register after he refused an offer of accommodation, and that it unreasonably made bids on his behalf for unsuitable properties. But the Ombudsman will not investigate this complaint. This is because the Council has offered to review the man’s housing priority again, and it is unlikely we could achieve a better outcome for him than that. There is also no sign of fault by the Council regarding other matters in the man’s case.

During my investigation, the Council has found that its files do not show how it considered all the information available to it and so it will review Mr K’s case and if he is entitled to more priority, it will backdate this. This is a reasonable way to settle this complaint.
