Summary: Miss C complained about the Council’s handling of her request for her daughter (X) not to attend school due to her risk of becoming seriously ill from COVID-19. We found no fault in how the Council considered and responded to her request. It was at fault for causing delays in finalising X’s final amended Education, Health, and Care Plan, but this did not cause Miss C or X an injustice. The Council should issue X’s final Plan and provide Miss C with her appeal rights.

Summary: Mrs Y complains on behalf of her adult son, Mr D, that the Council wrongly reduced his personal budget without explanation. She says Mr D’s eligible care and support needs have not changed. In our view, there is procedural fault because Mr D’s support plan does not contain a breakdown of his personal budget which has caused confusion for Mrs Y. The Council has agreed to remedy the injustice caused by fault with the actions listed at the end of this statement.

Summary: Mrs X complained the Council delayed issuing her son, Y’s, Education, Health and Care (EHC) Plan and failed to provide alternative provision when he was unable to attend school between June 2023 and June 2024. The Council was at fault in delaying issuing Y’s EHC Plan and failing to consider if it should provide him alternative provision. The Council will apologise to Mrs X, pay her £3,150 to recognise the frustration and uncertainty caused to her and for the term of education and specialist provision Y did not receive. The Council will also remind staff of its duties to consider alternative provision and respond to complaints fully.

Statement Upheld Charging 18-Feb-2025
Summary: Mr X complains the Council failed to deal properly with his late wife’s direct payments, by taking too long to audit them and then asking her estate to repay nearly £1,700. The Council failed to produce a detailed care and support plan in 2022. This resulted in a lack of clarity over what Mrs X’s direct payments could be used for. The Council needs to apologise, reduce its claim on Mrs X’s estate, pay Mr X for the distress caused and ensure officers improve their working practices.
