    Statement Upheld Commercial and contracts 02-Apr-2023

    Summary: Mr B complained about the Council’s Supported Needs Monitoring Group (SNMG) process. This related to the provision of supported accommodation for young people. He said that as a result a company of which he is a director missed out on the chance to provide the service. There was fault which caused injustice to Mr B. The Council will apologise and make a small payment.

    Statement Upheld Special educational needs 19-Apr-2023

    Summary: Mr X and Ms Y complained the Council failed to ensure their child D received a suitable alternative education while out of school or meet their special educational needs. There was fault in how the Council reviewed D’s Education Health and Care plan, re-assessed their Education Health and Care needs, and considered its duties to provide suitable alternative education. This meant D missed education, and support for their special educational needs, and caused avoidable distress for D, Mr X, and Ms Y. The Council agreed to apologise, issue an amended final Education Health and Care plan without delay, pay a financial remedy, review relevant procedures, and issue reminders to its staff.

    Statement Upheld Pollution 30-May-2023

    Summary: Mr Y complained about the way the Council dealt with his reports of persistent drain odour, rat infestations and noise disturbance from slamming doors at his private rented accommodation. We found fault by the Council because it did not follow its enforcement policy and did not suitably follow up on reports made by Mr Y between July 2022 and November 2022. The Council has agreed to apologise and make a payment to Mr Y in recognition of the uncertainty and time and trouble caused to him.

    Statement Upheld Homelessness 07-Jun-2023

    Summary: Miss X complains she has had to deal with constant disrepair in her temporary accommodation. We find fault with the Council for failing to carry out repairs and deal with the various infestations in a timely manner. We have agreed a financial remedy for Miss X for the inconvenience and distress caused.

    Summary: We will not investigate this complaint about a Liability Order because the matter has been remedied and there is insufficient remaining injustice to warrant investigation.

    Statement Upheld Allocations 01-Aug-2023

    Summary: Ms X, on behalf of her son Mr Y, complained the Council was discriminatory as it did not properly consider new medical evidence or his circumstances for his application to the housing register. We found the Council at fault for not carrying out homelessness enquiries. The Council has agreed to our recommendations to remedy this injustice.

    Statement Upheld School admissions 08-Aug-2023

    Summary: the Council delayed processing Miss B’s in year school admissions application, delayed referring the matter to the fair access panel, failed to consider whether it was appropriate to send Miss B’s daughter back to the allocated school and failed to keep Miss B up-to-date with what was happening. An apology, payment to Miss B, agreement to refer the case back to the fair access panel and a reminder to those sitting on fair access panels of the requirements when considering a case is satisfactory remedy.

    Statement Upheld Homelessness 09-Aug-2023

    Summary: the Council was at fault because it delayed assessing whether Mr Z was vulnerable and in priority need when he was homeless. However, when it later completed the assessment, it decided he was not vulnerable and so he was not owed the interim accommodation duty. This means the delay did not cause injustice to Mr Z. There was further fault because the Council failed to issue a Personalised Housing Plan when it accepted the relief duty. This caused some uncertainty about the steps the Council had agreed to take to relieve Mr Z’s homelessness and it denied him the option of requesting a review if he disagreed with them. The Council has agreed to provide a suitable remedy for this injustice.

    Statement Upheld Child protection 30-Aug-2023

    Summary: Dr X has complained about the Council’s handling of child protection matters relating to his five children. The Council was at fault for delays in providing copies of professional reports and insufficient notice of some meetings to Dr X. The Council has already taken appropriate action to remedy the injustice caused to Dr X by these faults.

    Statement Upheld School transport 30-Aug-2023

    Summary: factors outside the Council’s control led the Council to suspend school transport for one of Ms M’s children. However, the Council accepts it handled the matter badly. The Council apologised and offered a symbolic payment. We have made recommendations.
