Summary: Miss X complains about the Council’s handling of her concerns about a leaking roof causing damp and mould in her temporary accommodation. The Council has already acknowledged some fault, apologised to Miss X, made service improvements and offered a symbolic payment. We have found additional fault with the Council’s record keeping. This has caused Miss X an injustice in the form of distress and uncertainty. The Council has agreed to pay Miss X £400 for the injustice caused.

Summary: Mr X complained the Council wrongly issued him with a Fixed Penalty Notice for littering when he left domestic refuse out too early. We found the Council at fault because it was not clear how it considered the full range of powers available before deciding to issue the notice but consider the agreed action of a refund of the amount paid by Mr X and a reminder to relevant staff provides a suitable remedy.

Summary: Miss X complained about the Council’s decisions regarding her housing application and how it considered her medical evidence. We found some fault with how the Council did not demonstrate its own decision making. However, we do not consider it caused Miss X a significant injustice. The Council delayed with a reassessment and has agreed to remedy the injustice this caused.

Summary: The Council was at fault for failing to deliver Mr B’s son’s speech and language therapy for around two months. It was also at fault for being slow to investigate whether other aspects of his special educational needs support were being delivered. It has already offered Mr B suitable remedies for his – and his son’s – injustice. It will also take steps to improve its service.

Statement Upheld Special educational needs 21-Jul-2024
Summary: the Council failed to check arrangements were in place at a mainstream nursery to deliver special educational provision for Mr F’s daughter G. G did not receive provision for the 15 hours a week she attended the nursery between June 2022 and December 2023. We find fault with the way the Council amended G’s Education, Health and Care (EHC) Plan in anticipation of her transfer to school. Due to a lack of capacity, the Council then applied a blanket policy and failed to consider G’s individual circumstances which delayed her full-time attendance at a special nursery. We have recommended a remedy for the injustice caused.

Summary: Miss X complained about the Council’s handling of her homelessness application and the temporary accommodation it put her in. There are parts of the complaint we have not investigated because too much time has passed. We find the Council at fault for not completing repair work to Miss X’s property, which left her with water and sewage problems. The Council has agreed to follow up on the remedies it has offered as they are satisfactory to remedy any injustice caused.

Summary: HOS found the Council has provided reasonable redress for Ms X’s complaint regarding works to her kitchen. LGSCO did not find fault in how the Council assessed whether Ms X’s property could be adapted to meet her needs. LGSCO found fault in how the Council decided Ms X’s priority for rehousing in 2022. Both Ombudsmen found fault with the Council’s complaint handling. The Council has agreed to apologise to Ms X, make payments, and act to improve its services.

Summary: Ms X complains about the Council’s handling of her adult child’s Blue Badge renewal and theft of Blue Badges from her vehicle. The Council was at fault for taking too long to process the Blue Badge renewal. The Council has agreed to apologise to Ms X and clarify the parking rules outside her home.

Summary: Miss X complained the Council failed to consider relevant medical information and as a result placed her in unsuitable interim and temporary accommodation between June and October 2023. There was no fault in how the Council considered the medical information Miss X initially provided. However, the Council was at fault for failing to consider medical evidence she later provided and not reassessing the suitability of the interim accommodation at that point. The Council also delayed accepting the main housing duty which delayed Miss X’s right to request a review of the suitability of accommodation. This caused her distress, uncertainty and meant she stayed in unsuitable accommodation for longer than necessary. The Council has agreed to apologise, make a symbolic payment to Miss X and backdate her Housing Register application.
