Summary: Mr and Mrs X complain the Council did not deal with a footway crossing application properly. The Council fettered its discretion and did not consider the individual circumstances of the application. Mr and Mrs X remains uncertain whether their application would be successful. The Council should reconsider Mr and Mrs X’s footway crossing appeal on its individual merits, review its policy and provide guidance to staff.

Summary: Mrs X complained about how the Council has supported her while she is homeless. There was fault in how the Council recorded and explained to Mrs X some of its decisions, how it decided what steps it should take to protect Mrs X’s belongings and how it failed to keep some video footage of an incident involving Mrs X. This caused Mrs X avoidable distress and uncertainty for which the Council agreed to pay her the financial remedy it has offered. It also agreed to review its policy on protecting the belongings of homeless people and the support it provides to Mrs X with this.

Summary: We found fault by the Council on Mrs N’s complaints about it taking too long to decide her homeless application and failing to move her from temporary and interim accommodation it agreed was unsuitable. It delayed deciding her application and issuing her Personal Housing Plan. It failed, and continues to fail, to move her from unsuitable accommodation. The agreed action remedies the injustice caused.

Summary: We found fault in the way the Council dealt with the complainant’s (Ms X) application for the change of her housing register priority banding, how it reviewed her Personalised Housing Plan and addressed her needs for reasonable adjustments. We also found fault in the Council’s refusal to let Ms X view a property she bid for. The Council agreed to apologise and make a symbolic payment to Ms X to recognise her distress and a delay in offering her a suitable property. The Council also agreed to include in Ms X’s housing records agreed reasonable adjustments for any written communication with her. The Council agreed to improve its record keeping and provide staff with the training on reasonable adjustments.

Summary: Mr B complained about the service provided to him by the Council after he became homeless. We cannot investigate part of his complaint about the suitability of temporary accommodation the Council provided. But we uphold the other part, finding some fault as the Council failed to give reasons when it declined to reconsider Mr B’s priority for rehousing under its housing allocation scheme. This caused Mr B uncertainty. To remedy this injustice, the Council has agreed to review its decision.

Summary: The Council has been at fault as a family has spent almost a year in unsuitable accommodation. The family spent 30 weeks in Bed and Breakfast accommodation and a further eight months in a hostel. The family now have temporary accommodation in a house. An apology and a payment remedies the injustice to them.

Summary: Ms X complains the Council was at fault as it left her in unsuitable temporary accommodation due to delays in moving her into more suitable accommodation. We found fault because the delay meant Ms X and her family remained in unsuitable temporary accommodation and we have made an appropriate recommendation. So we have completed our investigation.

Summary: Miss F complained the Council had failed to keep her siblings safe from neglect and harm and as a result has left her brother homeless and her sisters at risk of harm. We found fault by the Council as it had not dealt with this complaint under the statutory children’s complaints process. It has agreed to do so now. It will also make a symbolic payment to Miss F to remedy the time and trouble she has been caused and review information about Miss F’s siblings to determine if safeguarding enquiries are necessary.
