    Summary

    We have upheld Ms X’s complaint about the way the Council handled her housing register application. The Council has agreed to take action to remedy the uncertainty and avoidable time and trouble caused.

    The Council will remind relevant staff of the importance of issuing a decision with review rights when it changes the priority band or effective date on a housing register application.

    Summary

    The Council carried out the Education, Health and Care (EHC) needs assessment without fault. The Council was at fault for failing to consider its section 19 duty after Mr X told the Council his child (Y) was not attending school. The Council has agreed to apologise and make a symbolic payment to remedy the distress, frustration and uncertainty caused.

    The Council has agreed to create an action plan to ensure the Council makes and stores clear and accurate records of section 19 decision making for children out of school.
