Summary: Mr X complained about the Council’s delay in reviewing its decision on his housing application, which delay was severely affecting his health. We found there was avoidable delay by the Council, which caused uncertainty and frustration for Mr X. To put matters right, having issued its review decision during our investigation, the Council agreed to apologise to Mr X and make a symbolic payment of £500.

Summary: Mrs B says the Council failed to carry out proper care planning before she entered the care home, failed to ensure the care home provided for her cultural needs, failed to put in place sufficient support, failed to carry out proper risk assessments, carried out a financial assessment which left her with an inadequate amount to live on and gave her representative wrong information about the complaints process. There is no fault in how the Council carried out care planning or in how it carried out the financial assessment. There is some evidence of the care home not following through with some of the actions in the care plan and failing to provide Mrs B with culturally appropriate meals. There is also evidence of the Council giving Mrs C wrong information. An apology, payment to Mrs C, writing off some of Mrs B’s arrears and monitoring of the care homes records is satisfactory remedy.

Summary: We will not investigate Ms X complaint about the Council’s handling of reports of anti-social and criminal behaviour from a neighbour. This is because the complaint is outside the Ombudsman’s jurisdiction as there are ongoing court proceedings.

Summary: We have upheld Mr X’s complaint about the Council’s failure to consider his complaint about a lack of regular maintenance for a park on his street. The Council has agreed to resolve the complaint early by investigating Mr X’s complaint under its complaints procedure, which is a proportionate remedy for the injustice caused.

Summary: Ms X complained about the length of time the Council took to make and fit a replacement external door at her home. We found fault because the Council did not submit measurements it took for the door which then led to avoidable delays in the new door being made and fitted. Ms X suffered avoidable distress and frustration. To remedy the injustice caused by this fault, the Council has agreed to apologise, make a payment to Ms X and issue reminders to officers.

The Information Commissioner’s Office is better placed to consider that complaint. We will not investigate the Council’s delay in reviewing its decision that X did not meet the criteria for medical priority or communicate with them about it because the Council has already made an appropriate offer to remedy the injustice caused.

Summary: The Council was at fault for failing to respond to a homelessness referral, wrongly telling Mr X he had to give up his tenancy in order to proceed with a homeless application and failing to accept homelessness duties to him. The Council has agreed to apologise, proceed with Mr X’s homeless application, make payments to him, and act to improve its services.

Summary: Mr B complained how the Council handled his application to rejoin the housing register. He says the Council has not properly considered his medical evidence and mobility issues, and it has taken too long to complete its review. He also complained the Council has failed to provide him with adult social care support despite his repeated requests. We find the Council was at fault for its significant delays in dealing with Mr B’s review request. It was also at fault for how it handled Mr B’s requests for adult social care support. The Council has agreed to our recommendations to address the injustice caused by fault.
