  • Leicestershire County Council (24 002 382)

    Statement Upheld Direct payments 09-Jul-2024

Summary: We will not investigate this complaint about delay issuing a refund for overpayment of adult social care fees. This is because the Council has accepted its fault, apologised for the impact on the complainant, and acted to prevent future failures. It is unlikely the Ombudsman would add anything to the Council’s investigation or achieve anything further. We are satisfied with the actions the Council has taken to resolve the complaint.

Summary: We will not investigate this complaint about delays to an Education, Health, and Care needs assessment. The Council has acknowledged the delays and made a suitable offer of a financial remedy to address the injustice caused by the delay.

  • Leicestershire County Council (24 009 261)

    Statement Upheld Charging 13-Nov-2024

Summary: We will not investigate this complaint about the Council incorrectly recording that Mr X’s care had been funded by NHS continuing healthcare. It apologised to Mrs X for its error and reissued invoices for the correct amount. We could not achieve anything further.

  • Leicestershire County Council (24 011 751)

Statement Upheld Special educational needs 06-Jan-2025

Summary: We will not investigate Miss X’s complaint. We are unlikely to achieve a significantly different remedy for the Council’s delay in issuing an Education Health and Care Plan. • Leicestershire County Council (24 001 988)

Statement Upheld Special educational needs 26-Feb-2025

Summary: Mrs X complains the Council did not deal properly with her son’s education. The Council did not follow statutory timescales, did not consult schools in time, did not ensure education provision for her son and did not communicate effectively with her. Mrs X suffered a delayed right of appeal, avoidable distress and uncertainty, and Y missed special educational needs provision. The Council has offered an appropriate remedy.
