Summary: Miss X complained the Council failed to provide suitable school transport to her child. She said the Council failed to properly explain its decision, consider the family’s circumstances, or have regard for its duties under the Equality Act 2010 when making decisions about transport. We have found the Council acted with fault by failing to properly consider Miss X’s requests through its transport appeals procedure. We have made recommendations to remedy the injustice this caused.

Summary: Miss X complains about the Council’s handling of her applications to the housing register since 2022. There was no fault in the Council’s handling of Miss X’s housing register application in 2022. The Council was at fault for the way in which it processed Miss X’s 2023 housing register application and its poor communication with her about this. The Council has agreed to apologise and take appropriate steps to reinstate Miss X’s place on the housing register.

Summary: Mrs X complained about how the Council met her son, Z’s, special educational needs. There was fault in how the Council took too long to issue Z’s Education Health and Care plan in 2022, and delays in starting speech and language therapy in 2023. This caused Mrs X avoidable frustration and worry for which the Council agreed to apologise and pay her a financial remedy. It also agreed to review how it manages and monitors special educational needs assessments.

Summary: Ms A has complained on behalf of a residential care home about a lack of funding by a council and an integrated care board for the increased support the care home provided to a resident. Ms A has also complained about a lack of safeguarding by the Council. We do not find fault with the Integrated Care Board. We find fault with the Council in relation to funding and safeguarding leading to a financial shortfall and increased risk for the Home. The Council has agreed to a financial remedy, apology and a reminder to staff as a satisfactory remedy.

Summary: There was fault by the Council when it failed to progress a reassessment of a child’s Education Health and Care (EHC) needs, and issue an amended EHC Plan. The Council also failed to consider what action it should take to make sure the child received the education under his existing Plan, when he was not attending school; and it failed to transfer the EHC Plan in good time when the family moved area. The Council’s shortcomings meant that the child missed education and caused him and his family distress and uncertainty. It has agreed to remedy the injustice.

Summary: Mrs B says the Council wrongly refused to pay towards the cost of an extension as part of a disabled facilities grant application after completing an inaccurate means test. There is no evidence of fault in how the Council reached its decision. The Council failed to properly explain a means test was required before any payment would be released. An apology is satisfactory remedy for that.

Summary: Ms X complained about how the Council handled her son, Y’s Education, Health and Care (EHC) Plan and education since 2020 and how it considered her complaints about those matters. The Council delayed issuing Y’s amended EHC Plan after an annual review meeting in December 2022 and its complaint response was unclear. The Council will apologise to Ms X for the uncertainty and frustration caused to her and pay her a symbolic amount of £300. The Council will remind its staff to act in line with the timelines set out in statutory guidance for EHC Plans.

Summary: Ms X complains that the Council failed to provide sufficient support with her homelessness and failed to provide suitable accommodation for her and her children. As a result, Ms X and her family have been living in unsuitable accommodation for longer than necessary which has caused significant distress. Ms X also considers the stress of living in unsuitable accommodation has significantly affected her mental and physical health.

Summary: There was no fault in how the Council decided not to fund a ramp so Mr B could store a mobility scooter under its minor adaptations policy. However, the Council’s communication about this was at times unclear, particularly on whether council tenants can apply for a Disabled Facilities Grant (DFG). There was no fault in how it dealt with Mr B’s request for other minor adaptations.
