    Summary: We will not investigate this complaint about adult social care. The complainant lives next door to a supported living property and has experienced damage to property, and assault. There are other bodies better placed to consider these concerns as they are for the police and insurance companies. There is no worthwhile outcome achievable from an Ombudsman investigation, and we are satisfied with how the Council responded to the complaint.

    Summary: Mrs X complained about the Council’s provision of education, and handling of the education, health and care process for her two children which caused missed education and significant distress. We find the Council at fault for its failure to provide suitable alternative education, meet statutory deadlines, and for poor communication and complaint handling, which caused injustice. We find the Council has already offered a suitable remedy for the injustice. We have decided to end our investigation into other areas of the complaint because they are late or have been appealed to the Tribunal.

    Summary: The Council accepted that it had delayed in issuing the complainant’s son’s Education, Health and Care Plan. We too find fault, resulting in avoidable distress and a loss of suitable education for Miss X’s son. The Council had already offered to make a symbolic payment for the lost education and avoidable distress and time and trouble for the complainant. We consider this is a suitable remedy. We are therefore closing the complaint.

    Summary: A care home, acting on behalf of the Council, acknowledged an initial oversight in having a bathing/showering plan in place for Mrs Y before the complaint came to this office. It verbally apologised to her daughter and took action to remedy the situation. There is no further remedy required from this office. There is no evidence to show the care home delayed seeking medical assistance for Mrs Y.

    Summary: Miss Y complains the Council failed to arrange provision for her child, D, once it became aware they were not attending school. She also complains about a refusal to assess D for an Education Health and Care Plan. The Council has already accepted fault and made an appropriate financial remedy for the first part of Miss Y’s complaint. We have not investigated the second part of Miss Y’s complaint because she has already used her right of appeal to the relevant tribunal.
