    Summary: Mrs B complained about delays in the education, health and care plan process for her child, C. She also complained the Council failed to provide C with the provision in the plan and suitable education when they were not attending school. We found fault with the Council. The Council agreed actions to remedy the injustice to Mrs B and C.

    Summary: Mrs D complained the Council delayed dealing with Mr F’s Education, Health and Care plan after the annual review. She also complained the Council delayed responding to the complaint. We find the Council was at fault for its delays in finalising Mr F’s Education, Health and Care plan. It also delayed responding to the complaint. The Council has agreed to our recommendations to address the injustice caused by fault.

    Summary: We will not investigate this complaint about the Council’s alleged failure to provide a finalised Education Health and Care Plan. The Council has now provided the plan, and it is reasonable to expect Miss X to appeal to the Special Educational Needs and Disability Tribunal.

    Summary: Ms C complains the Council has wrongly pursued her for arrears in home support charges and withdrawn her support. The Council is at fault for failing to communicate and assess charges properly and the way in which it reassessed Ms C’s care needs. The Council has agreed to apologise to Ms C, complete a reassessment of her care needs including a support plan, and update invoices. It has also agreed to provide staff reminders, and if necessary training, about the completion of support plans.

    Summary: Mrs X complained that the Council failed to properly consider her complaint that she was being charged for a government funded ‘free’ nursery place. We found there was some delay in the investigation. We also found the Council should have sought to obtain a refund of the inappropriate charges that the nursery made to Mrs X.

    Summary: Mr D complained about the Council’s handling of his three children’s Education, Health and Care plans. The Council agreed it caused delays in reviewing and amending their plans, and it failed to provide some special educational needs provision. This was fault. It will apologise to Mr D and his children, and make payment to acknowledge the distress, time and trouble, and loss of provision they experienced.

    Summary: The Council was at fault in the failure to review contact restrictions. This caused a family including members with disabilities, avoidable distress. The Council agreed to take action described in this statement including offering an advocate to Mr and Mrs X’s daughter. This is appropriate to remedy the injustice.

    Summary: The Council failed to properly assess the impact of reducing Mr X’s care package. This put his health and wellbeing at risk and led to a loss of care provision for almost a year. It also caused him distress, uncertainty and time and trouble. The Council has agreed to pay Mr X £1,600 to acknowledge the avoidable injustice caused by these faults and has committed to making our recommended service improvements.

    Statement Upheld School transport 16-Jun-2022

    Summary: We upheld Mr X’s complaint. There was a delay in (1) dealing with Mr X’s application for a personal transport budget, (2) actioning his request for changes to the school transport arrangements and (3) responding to the complaint. The Council will apologise, reimburse Mr X the money it has already agreed and pay him an additional £250 to reflect his avoidable frustration and time and trouble complaining.

    Summary: The Council was at fault for the delay in finding Mrs X’s son a suitable school placement and provide him with the provision as outlined in his Education, Health and Care Plan. To remedy the injustice caused by the fault, the Council has agreed to make a payment to Mrs X and her son. The Council has also agreed to make a service improvement.
