    Summary: Ms X complained that the Council failed to provide full-time education and special educational provision for her son (Y). She also complained about the Council’s delay in reviewing Y’s Education Health and Care Plan, its failure to re-assess Y’s speech and language needs and to communicate with her. We found fault with the Council. This fault caused injustice to Y and Ms X. The Council has agreed to apologise and make payments to recognise Y’s loss of provision and Ms X’s distress. The Council has also agreed to reimburse Ms X for the cost of a Speech and Language Therapy report.

We found fault with the Council for its failure to consider Ms X’s complaint through its children’s statutory complaint procedure. The Council’s fault caused injustice to Ms X. The Council has agreed to apologise and make a symbolic payment for Ms X’s distress.

We asked the Council to remedy the injustice caused. It agreed to apologise and reduce the costs it charges Mr Y. It will also take action to prevent a recurrence of this issue.

On the evidence considered the Council was at fault. It failed to properly consider Y’s circumstances, to hold a stage one review and to properly record and explain its decision making. This leaves doubt over the decision reached. The Council has agreed to apologise to Mr X for the frustration and uncertainty caused, review Mr X’s appeal, review its processes and arrange training for relevant school transport staff and panel members.

    Summary: the Council took too long to update Mrs M’s son B’s education, health and care (EHC) plan. We cannot investigate Mrs M’s complaint about the lack of alternative provision because of her appeal to the SEND Tribunal. Mrs M should complain to the Council in the first instance about the missing assessments ordered by the Tribunal. The Council has provided a suitable remedy for the delay updating B’s EHC Plan.

    Summary: Mrs M complained on behalf of herself and her adult daughter, Miss D. She complained about faults by City of Bradford Metropolitan District Council and NHS West Yorkshire Integrated Care Board leading to Miss D being unable to go to college and missing out on special educational provision. She also complained about poor communication by the organisations. We have upheld the complaint and found the faults caused significant injustice to Miss D and Mrs M. This includes Miss D missing all her education and essential special educational needs support for about 12 months. Mrs M could not take her usual breaks from her caring role, leaving her exhausted. The organisations’ faults also caused Mrs M avoidable distress and time and trouble. The organisations accepted our recommendations, so we have completed our investigation.
