Statement Upheld Charging 13-May-2024
Summary: Mr X complains about the Council’s handling of his mother’s (Mrs Y) care and assessment since she was admitted to hospital in September 2022. The Council was at fault for the avoidable delay in assessing Mrs Y’s needs and contribution to care costs. It has already taken appropriate action to remedy the injustice caused by this delay. There was no evidence of fault in the Council’s interactions with Mr X about choice of residential care placement or the quality of care Mrs Y received.

Statement Upheld Charging 16-May-2024
Summary: Mr X complained Norwood House Care Home breached the terms of their agreement by increasing his mother, Ms Y’s, top up fee several times without proper notice or consultation and without notifying the Council. We found there was fault causing injustice when the Care Home failed to follow the correct procedure to increase fees, and when the Council failed to provide information in writing. However, we were satisfied the Council already remedied the injustice.

Statement Upheld Residential care 23-May-2024
Summary: We will not investigate this complaint about adult social care in a residential care home. This is because it is unlikely that we could add to investigations already undertaken by the Care Provider and the safeguarding authority. It is unlikely an Ombudsman investigation would lead to a different outcome.

Statement Upheld Trees 15-Oct-2024
Summary: We will not investigate this complaint about the Council issuing inconsistent instructions to the complainant regarding a hedge overhanging the highway. We are satisfied with the action the Council has already taken, it is reasonable to expect the complainant to have used his right of appeal in the magistrates court, and we will not pursue his concerns about the complaints process in isolation.
