The Council has offered to pay Ms X £500 to acknowledge this. There is no fault in the way the Council reached its decision to grant planning permission for a second planning application for the site based on amended plans.

    Summary: Ms X complains the Council will not allow her to remain living in the property she has lived in for over 50 years. The Ombudsman cannot investigate this complaint as the substantive matter, which has been considered by the Housing Ombudsman, falls outside our jurisdiction and an investigation is unlikely to find evidence of fault by the Council in relation to matters concerning its Allocations Policy.

    Summary: The Ombudsman will not investigate this complaint that the Council has forced the complainant to live in her car because it provided unsuitable accommodation. This is because there is insufficient evidence of fault by the Council and because the complainant could have used her appeal rights.

    Summary: We cannot and will not investigate a residents’ association’s complaint about the accuracy of Planning Committee minutes. This is because the Residents’ Association took legal action against the Council regarding a planning application it approved in the Association’s area. And the injustice its members have suffered because of other planning applications is not significant enough to justify our involvement.

    Summary: Mr X complained about how the Council responded to a neighbour’s pre-application planning advice request and decided to approve the neighbour’s planning application. The Council was at fault but this did not cause Mr X significant personal injustice.

    Summary: We will not investigate Ms B’s complaint that the Council refused to deal with her complaint about a developer’s infringement onto a right of way and failed to accept the developer submitted the planning application without the correct certificate. This is because there is insufficient evidence of fault by the Council.

    Summary: Ms D complains the Council failed to deal effectively with noise nuisance and anti-social behaviour from her downstairs neighbour. We have found no fault by the Council.

    Summary: On the evidence currently available, we will not investigate this complaint about how the Council has dealt with Mr X’s planning application. This is because Mr X has a right to appeal to the Planning Inspector. Mr X can also contact the Information Commissioner’s Office if he is not satisfied with the Council’s response regarding an alleged data protection breach.
