    Summary: There was fault by the Council. It took too long to issue a final Education Health and Care Plan to Mr K; did not complete a transport assessment nor offer funding for travel to college in good time; did not always communicate with his mother, Mrs X properly; and did not make a personal budget available to Mr K to pay for the provision set out in his Plan. This caused Mr K and Mrs X distress and uncertainty. It meant that Mr K did not receive all of his provision. The Council should apologise to Mrs X and Mr K. It should make symbolic payments in recognition of the impact on Mrs X and Mr K.

    Summary: Ms X complains the Council has delayed in offering new temporary accommodation despite accepting the current accommodation was unsuitable. Ms X says this has caused her and her family a great deal of distress. We have found fault in the Councils actions for delaying in reviewing Ms X’s accommodation and delay in offering suitable accommodation. The Council has agreed to issue Ms X with an apology and pay her a financial payment.

    Summary: Mrs X complains about the care and support provided to her daughter after her autism diagnosis. Based on current evidence I have found fault by the Trust and the Council. However, they have accepted this and provided a suitable remedy for most of the complaint. We have recommended the Trust apologises for distress caused by fault relating to a delayed referral for therapy. We have also recommended the Trust acts to ensure safeguards are in place to prevent similar fault in future.

    Summary: We upheld a complaint from Mr B about the Council’s response to concerns he had about the incomplete housing development he lives on. We found the Council’s planning enforcement service communicated poorly with Mr B, including after he complained, and it lacked a clear plan to tackle the issues he raised. These faults caused Mr B unnecessary uncertainty, time and trouble. The Council accepted these findings and at the end of this statement, we set out the action it agreed to take to remedy this injustice and improve its service.

    Summary: The Council was at fault for failing to adhere to the statutory timescales in reviewing Mr X’s child’s Education, Health and Care Plan. The Council was also at fault for failing to ensure delivery of Mr X’s child’s Education, Health and Care Plan provision. The Council agreed to apologise to Mr X and his child and provide a symbolic payment for the avoidable frustration and distress caused and the missed Education, Health and Care Plan provision.

We found delay in seeking a home care provider which caused uncertainty. The Council has agreed to make a symbolic payment to Mrs B to remedy this injustice. We found no fault in the rest of the complaint. There is no evidence the Council has not had due regard to Mrs B’s human rights.
