This complaint was received outside the normal 12-month period for investigating complaints. There is no evidence to suggest that Mr X could not have complained to us sooner. We have no discretion to investigate complaints which have been subject to court proceedings.

    Summary: Ms X complained about how the Council responded to her brother Mr Y’s homelessness applications in 2023. We found several faults. There were months of delays by the Council and basic administrative errors. The Council repeatedly failed to respond correctly to Mr Y’s attempts to access support from its housing service. This meant that instead of being housed by the Council, Mr Y had to live with another of his sisters, Ms Z, despite her being seriously unwell and despite the impact of his mental health needs on their wellbeing. The faults caused Mr Y, Ms X and Ms Z significant stress and upset.

    Summary: We will not investigate this complaint about the Council’s decision not to make alternative educational provision for the complainant’s daughter because there is insufficient evidence of fault on the Council’s part. We cannot investigate her complaint about the Council’s refusal to carry out an Education Health and Care Needs Assessment because she has used her right to appeal to the First-tier Tribunal (Special Educational Needs and Disability).

    Summary: Mrs X complained on behalf of her father, Mr Y about the way Lincolnshire County Council and United Lincolnshire Hospitals NHS Trust discharged him from hospital to a care home, The Old Rectory. The Hospital Trust acted with fault when it discharged Mr Y and should apologise to Mrs X for the uncertainty it caused her. It should also take action to avoid similar fault. Mrs X also complained about Lincolnshire Community Health Service NHS Trust’s support for Mr Y’s pressure sores. We found the Community Trust should have started care planning sooner than it did. While that did not cause any injustice, it should take action to avoid similar fault in future.

    Summary: We do not uphold G’s complaint about City of York Council and NHS Humber and North Yorkshire Integrated Care Board’s decision to reduce their section 117 aftercare in December 2023. However, the Council and ICB should have reviewed G’s aftercare need before they left hospital in March 2024. That caused them distress, and the organisations should jointly apologise for that.

    Summary: We do not uphold G’s complaint about City of York Council and NHS Humber and North Yorkshire Integrated Care Board’s decision to reduce their section 117 aftercare in December 2023.     Summary: Ms X complained the Council’s consideration of a complaint she raised through the children’s statutory complaint procedure about how the Council cared for a child, Y, was flawed. We found the Council was at fault when it overturned some of the statutory investigation’s findings, and did not provide an appropriate remedy to Y for the complaints it did uphold. This included that Y became isolated and institutionalised while they remained in an unregistered placement for more than four years. The Council will apologise and make a payment to Y.
