  • Nottinghamshire County Council (25 008 091)

Statement Closed after initial enquiries Special educational needs 03-Oct-2025

Summary: We will not investigate this complaint about the Education, Health and Care Plan process for Mr X’s child. There is not enough evidence of fault by the Council, and it was reasonable for Mr X to appeal to the First Tier Tribunal (Special Educational Needs and Disability). Mr X can submit a late appeal to the Tribunal if he thinks the Council did not properly advise him of his appeal rights.

  • Brighton & Hove City Council (24 017 916)

Statement Upheld Refuse and recycling 02-Oct-2025

Summary: Ms X complained the Council wrongly issued her with a Fixed Penalty Notice regarding commercial waste when she does not run a business. Ms X says this has cost her financially, through payment of the penalty and loss of income. She said this also caused her distress. There was fault in the way the Council did not explain its position, did not allow Ms X to explain her position and the complaint handling was poor. This frustrated Ms X and she was put to time and trouble to complain. The Council agreed to refund the penalty notice as it offered, make a financial payment, provide guidance to its staff and review its policy.

  • Swale Borough Council (24 018 158)

    Statement Not upheld Enforcement 02-Oct-2025

Summary: Ms X complained the Council failed to take enforcement action over planning breaches relating to protection of bird habitats. We found the Council properly investigated reported planning breaches and was not at fault for not taking formal enforcement action.

  • Bassetlaw District Council (24 018 602)

Statement Closed after initial enquiries Council tax 02-Oct-2025

Summary: We will not investigate this complaint about the Council’s failure to ensure properties were correctly named and addressed. Further investigation would not lead to a different outcome for the complainant in this matter.

  • Gloucestershire County Council (24 019 290)

    Statement Upheld Charging 02-Oct-2025

Summary: There was fault by the Council. The Council sent contradictory letters which caused confusion on whether the Council would fund a care home placement. This meant the transition from Council funded to self-funded care was not well managed and the complainants were not given the option of the Council managing the care, with the complainants paying the full cost. Reviewing the procedures to ensure they comply with the Care Act 2014 and paying the care home fees owed once the upper capital threshold would have been reached remedies the injustice caused.

  • Halton Borough Council (24 019 523)

Statement Upheld Parking and other penalties 02-Oct-2025

Summary: We will not investigate this complaint about the Council’s handling of penalty charge notices issued to Mr X. This is because the Council has offered Mr X a suitable remedy for his injustice and it is unlikely investigation would achieve significantly more for him.

  • London Borough of Barnet (24 022 083)

Statement Upheld Refuse and recycling 02-Oct-2025

Summary: Mr D says the Council failed to rectify pavement obstructions near a zebra crossing which causes issue for pedestrians who are visually impaired. I have found the Council at fault. The Council agrees to apologise to Mr D and will offer to meet him to discuss its actions in the case.

  • Somerset Council (24 001 770)

    Statement Upheld Alternative provision 02-Oct-2025

Summary: Ms F complained the Council failed to put in place alternative provision for her daughter and delayed issuing a final EHC Plan. As a result, her daughter’s education has suffered and the family was caused significant stress. We found there was a five-month delay in issuing the plan and fault in not providing alternative provision for three school terms. The Council has agreed to apologise and pay Ms F £6,000 to be used for her daughter’s educational benefit to remedy the injustice.

  • West Sussex County Council (24 009 544)

Statement Upheld Special educational needs 02-Oct-2025

Summary: Mrs H complained that the Council did not ensure her son was receiving alternative education after he was unable to attend school. And it delayed reviewing his Education, Health and Care Plan. We uphold the complaint because of both the Council not considering its alternative education duties and a delay in revising the Plan. The Council has agreed to our recommendations.

  • London Borough of Redbridge (24 010 988)

Statement Closed after initial enquiries Antisocial behaviour 02-Oct-2025

Summary: We will not investigate Mr X’s complaint about how the Council dealt with his reports of a noise nuisance at a nearby school. This is because there is insufficient evidence of fault.
