Statement Closed after initial enquiries Leisure and culture 31-Mar-2025

Summary: We will not investigate this complaint about the Council’s liability for an incident involving Mrs X at a leisure facility. This is because Mrs X has an alternative legal remedy through the courts, and it would be reasonable to expect her to use this alternative remedy.

    Statement Upheld Other 31-Mar-2025

Summary: Mr X complained the Council failed to comply with one of the recommended actions it agreed to complete following the Ombudsman’s investigation into his original complaint about how the Council handled his business rates account and its recovery action. There was fault by the Council for its failure to properly consider and complete the action within the agreed timeframe. This caused uncertainty and further distress to Mr X. The Council will take action to remedy the injustice caused.

The complainant also had the right to appeal to the Planning Inspector.

Statement Closed after initial enquiries Refuse and recycling 31-Mar-2025

Statement Closed after initial enquiries Parking and other penalties 31-Mar-2025

Summary: We will not investigate this complaint about damage to Mr X's car as this is a matter for the courts. Mr X can appeal to the independent tribunal about the penalty charge notice aspect of his complaint.

Statement Closed after initial enquiries Charging 31-Mar-2025

Summary: We will not investigate this complaint about financial assessment for adult social care charges, and the Council’s decision about a deprivation of asset. This is because it is unlikely we would find fault in the Council’s decision-making process or reach a different outcome.

  • Essex County Council (24 018 087)

Statement Closed after initial enquiries School transport 31-Mar-2025

Summary: We will not investigate Mrs X’s complaint about the Council’s decision not to provide her son with home to school transport. This is because there is not enough evidence of fault by the Council to warrant an investigation.

    Statement Upheld Enforcement 30-Mar-2025

Summary: Mr J complained that the Council failed to take action regarding a breach in planning conditions. Mr J says this caused stress and led to damage to his home. There were significant delays by the Council causing Mr J anxiety and uncertainty. The Council agreed to remedy this by updating Mr J and making a symbolic payment for the injustice caused.

  • Heathfield Care Homes Limited (23 020 500)

    Statement Upheld Residential care 30-Mar-2025

Summary: Mrs B complains about the care home’s delay in calling an ambulance for her mother and says her mother suffered dehydration and pressure sores because of the care home’s failures in care. We have not found fault in the way the care home decided to call an ambulance or its provision of liquids when Mrs B’s mother was taken to the hospital. However, there was fault in the way the care home assessed the risk of pressure sores and its care planning in this respect. The Home has agreed to apologise and carry out a service improvement.
