There is not enough evidence of fault by the Council, and it was reasonable for Mr X to appeal to the First Tier Tribunal (Special Educational Needs and Disability). Mr X can submit a late appeal to the Tribunal if he thinks the Council did not properly advise him of his appeal rights.

Summary: Ms X complained the Council wrongly issued her with a Fixed Penalty Notice regarding commercial waste when she does not run a business. Ms X says this has cost her financially, through payment of the penalty and loss of income. She said this also caused her distress. There was fault in the way the Council did not explain its position, did not allow Ms X to explain her position and the complaint handling was poor. This frustrated Ms X and she was put to time and trouble to complain. The Council agreed to refund the penalty notice as it offered, make a financial payment, provide guidance to its staff and review its policy.

Summary: There was fault by the Council. The Council sent contradictory letters which caused confusion on whether the Council would fund a care home placement. This meant the transition from Council funded to self-funded care was not well managed and the complainants were not given the option of the Council managing the care, with the complainants paying the full cost. Reviewing the procedures to ensure they comply with the Care Act 2014 and paying the care home fees owed once the upper capital threshold would have been reached remedies the injustice caused.

Statement Upheld Alternative provision 02-Oct-2025
Summary: Ms F complained the Council failed to put in place alternative provision for her daughter and delayed issuing a final EHC Plan. As a result, her daughter’s education has suffered and the family was caused significant stress. We found there was a five-month delay in issuing the plan and fault in not providing alternative provision for three school terms. The Council has agreed to apologise and pay Ms F £6,000 to be used for her daughter’s educational benefit to remedy the injustice.
