Summary: Mrs X complained to the Council about her neighbour’s extension blocking an access way to her property. Mrs X said when closing the investigation, the Council wrongly sent a letter intended for her to the wrong recipient. We find the Council was at fault for sending the letter to the wrong recipient, this caused Mrs X distress. The Council has agreed to our recommendation to remedy the injustice caused.

Summary: Mrs X complains about the Council’s handling following a disclosure of sexual abuse by her child, Child Y. There was no fault in the Council’s child protection enquiry into the allegation or the support offered to the family at the time. The Council took significantly longer than it should to respond to Mrs X’s stage two complaint. The Council should also have done more to act on requests for specific help made by Mr Z on Mrs X’s behalf. The Council has agreed to apologise and pay £100 to Mrs X for the injustice caused by the complaint response delay. The Council will also offer to complete an Education, Health and Care needs assessment of Child Y as Mr Z requested.

The Council is not at fault for how it applied its allocations policy for overcrowding need. It was at fault for not considering the damp, but it was unlikely to have changed her banding, so no injustice was caused. There is fault by the Council in failing to complete a statutory review of the suitability of the temporary accommodation or offering appeal rights. The Council has made a financial payment to her. It has also agreed to apologise and complete the statutory review.
