    Summary: Mrs X complained the Council failed to get suitable advice from the relevant professionals for her child’s Education, Health and Care Plan reassessment. Mrs X complained the Council refused to cover the cost she incurred getting relevant advice. We found fault with the Council failing to get Educational Psychologist input for Mrs X’s child’s Education, Health and Care Plan reassessment. The Council instead relied on the professional advice sourced by Mrs X but refused to reimburse this. The Council agreed to apologise to Mrs X for failing to get the relevant input, rebate the cost of the Clinical Psychologist advice she got and pay her £100 for the inconvenience and frustration caused.

    Summary: Mrs X complained the Council has failed to provide her son with any educational provision. We find the Council was at fault for failing to provide Mrs X’s son with the education and specialist provision in his Education, Health and Care Plan. This caused Mrs X distress and upset, and her son lost out on the education and provision he was entitled to. The Council apologised to Mrs X and paid £6,750 to reflect the missed education and provision and the distress and upset caused. The Council has agreed to our recommendation to pay a further £750 to reflect the loss of Mrs X’s son’s education and provision.

    Summary: We will not investigate this complaint about the Council’s decision to treat Miss X’s children as children in need. There is not enough evidence of fault by the Council to warrant investigation.

    Summary: Mrs X complained about the Council failure to advise her about her obligations under the direct payments scheme. We did not find the Council to be at fault because Mrs X signed an agreement that explained her responsibilities as an employer and to provide an audit trail. In the absence of any evidence to show how public finds were spent, the Council was entitled to request its return.

    Summary: Ms X complained that the Council failed to provide suitable full-time education to her son while he was unable to attend school. We have found no fault. The Council provided education which, in its view, met Ms X’s son’s needs, and it has explained why it did not consider it appropriate to make more education available to him. These were matters for the Council to decide and we have no power to question them.

    Summary: Miss B complained the Council delayed agreeing to reassess her son’s education, health and care plan, delayed seeking advice, delayed issuing a final education, health and care plan, failed to consult the relevant professionals and failed to respond to her correspondence. Based on current evidence the Council delayed confirming it would carry out a reassessment, in seeking advice and issuing a final EHC Plan and failed to respond to some of Miss B’s correspondence. That delayed Miss B’s appeal rights and has left her with distress and uncertainty. An apology and payment to Miss B is satisfactory remedy.
