Summary: Mr C complained the Council failed to issue a decision notice for his outline planning application following its approval and delayed in doing so for over a year. We have found fault but consider the agreed action of a refund of the application fee, symbolic payment and review of procedure provides a suitable remedy.

Summary: We will not investigate Mrs X’s complaint about the Council’s decision not to take enforcement action regarding a landscaping planning condition for a recent development. There is not enough evidence of fault in the Council’s decision-making process, nor insufficient injustice caused to Mrs X by the development as built, to justify an investigation. We also cannot achieve the outcome Mrs X seeks from her complaint.

  • South Somerset District Council (22 007 207)

Statement Closed after initial enquiries Enforcement 13-Sep-2022

Summary: We will not investigate Mr X’s complaint about the Council’s handling of a planning enforcement matter involving Mr X’s neighbour. The Council’s enforcement case is ongoing and we cannot determine the claimed injustice from the matter before the final planning and enforcement outcome is reached. Investigation at this time would not result in a different outcome for Mr X.
