    Statement Upheld Noise 06-Sep-2023

Summary: Mr X complained about the Council’s handling of noise complaints in 2021 and 2022. The Council did not properly investigate the noise reports in 2021 and failed to progress the 2022 reports after the case was transferred to its licensing team in August 2022. It also delayed in responding to the formal complaint and failed to send a written response. The Council will apologise, pay Mr X £200 for the uncertainty caused and make service improvements.

    Statement Upheld Enforcement 06-Sep-2023

Summary: Mrs X complains the Council has failed to take action regarding the unacceptable condition of the grounds in which her house is situated. We have found the Council failed to properly assess the safety of the site and respond to her first complaint. The Council has agreed to apologise, make a financial payment and service improvements to remedy the injustice caused.

  • South Lakeland District Council (22 013 601)

    Statement Upheld Planning applications 30-Jul-2023

Summary: Mr X complained about inaccuracies in information about a planning application and the way the Council made its decision to grant permission for the development. We have found fault by the Council in including an inaccurate measurement in its planning report and failing to keep a record of a site visit. We do not consider this fault affected the outcome of the application, but it has caused Mr X the injustice of avoidable concern and upset about the decision making process. The Council has agreed to remedy this injustice by apologising, making a payment to Mr X to reflect this distress, and service improvements.

  • South Lakeland District Council (22 003 972)

Statement Not upheld Planning applications 22-Jul-2023

Summary: Mr X complained about the way the Council approved planning permission for a housing development next to his property and its failure to take enforcement action following construction. There was some lack of clarity in the Council’s complaint responses, but we do not find fault in the Council’s decision to approve the planning application, or its decision not to take enforcement action.

  • South Lakeland District Council (22 009 396)

Statement Not upheld Planning applications 27-Jan-2023

Summary: Mr X complained that the Council failed to take enforcement action when a new house was not built according to the approved plans. He also complained about the way the Council handled an application for non-material amendments to the new build. Mr X said this caused a loss of privacy, amenity, and property value. He said it caused stress and he has lost faith in the planning process. We do not find the Council at fault.

  • South Lakeland District Council (22 006 555)

    Statement Not upheld Homelessness 24-Jan-2023

Summary: Ms F complained the Council placed an emergency prohibition order on their rented flat and only gave her and her son two days to move. She said it offered unsuitable interim accommodation and failed to do enough to prevent their homelessness. We found the Council did not cause delays and it reached decisions it was entitled to make. We cannot therefore criticise the merits of its decisions.

  • South Lakeland District Council (22 007 124)

Statement Closed after initial enquiries Enforcement 13-Sep-2022

Summary: We cannot investigate Mrs X’s complaint about the Council’s failure to take planning enforcement action against the owners of a property in its area. This is because Mrs X has complained as a member of the local parish council and does not claim any personal injustice from the issues she complains about. Her complaint therefore falls outside our jurisdiction.

Summary: We will not investigate this complaint about the Council’s recovery action against Mr X for council tax arrears. The complaint concerns the commencement of court proceedings and is outside the Ombudsman’s jurisdiction. Mr X also complained about delay in dealing with his information request and this is a matter which falls within the remit of the Information Commissioner.
