  • Suffolk County Council (23 004 009)

Statement Closed after initial enquiries Special educational needs 14-Aug-2023

Summary: We will not investigate this complaint that the Council has been at fault in addressing the complainant’s son’s special educational needs. This is because the matters about which she has complained carry the right of appeal to the First-tier Tribunal (Special Educational Needs and Disability), or are inextricably linked to those matters.

  • Suffolk County Council (22 010 176)

Summary: Ms X complained about the Council’s handling of the annual review of her daughter’s Education, Health and Care (EHC) Plan and delay in issuing her EHC plan. She also complained about its consideration of her request for a personal budget. We found evidence of fault by the Council. The Council has agreed to our recommendations to put right the injustice caused Ms X and her daughter and to improve its service.

  • Suffolk County Council (23 004 225)

Statement Closed after initial enquiries Highway repair and maintenance 12-Jul-2023

Summary: We will not investigate Mrs X’s complaint about the Council’s decision to refuse her claim for damages following a fall on the highway. This is because this is a complaint about negligence which is a legal matter for the courts to consider and decide and it is reasonable to expect Mrs X to use her right to pursue her claim in the courts.

  • Suffolk County Council (23 003 085)

Statement Closed after initial enquiries Alternative provision 05-Jul-2023

Summary: We will not investigate this complaint that the Council has failed to ensure the complainant’s daughter can access education and failed to identify a specialist placement appropriate for her needs. This is because it is unlikely we would seek to add anything significant to the remedy the Council has already offered.

  • Suffolk County Council (22 015 693)

    Statement Upheld Charging 02-Jul-2023

Summary: There were delays and errors in the way the Council handled the accrual of debt for Mrs A’s late mother Mrs X. The Council has apologised to Mrs A and taken some steps to improve services but should go further to recognise the distress she was caused.

  • Suffolk County Council (22 005 559)

    Statement Upheld Alternative provision 02-Jul-2023

Summary: Mrs X complained the Council failed to provide her son (Y) who has special educational needs with education or suitable alternative provision when he was unable to attend school due to ill health. We find the Council at fault as it did not act sooner to arrange alternative provision for Y and review the matter. The Council should apologise to Mrs X and make payments to reflect Y’s missed education and uncertainty and frustration caused. The Council should also make service improvements to prevent recurrence.

  • Suffolk County Council (22 016 014)

Statement Upheld Special educational needs 11-Jun-2023

Summary: Mrs D is making a complaint for her son (Mr P) who has special educational needs. Mrs D says the Council failed to support Mr P by meeting the identified provision in his Education and Health Care Plan (EHCP) which it must provide. She adds the Council’s handling of her concerns has been inadequate. We found the Council was at fault for a delay in providing the needed EHCP provision. The Council’s communication with Mrs D was not satisfactory as it failed to keep her updated and address her legitimate concerns. These failings caused an injustice and the Council has agreed to our recommendations to put this right.

  • Suffolk County Council (22 010 615)

Summary: Mr X complained the Council failed to notify him that he would be responsible for the full cost of residential care after 30 September 2021 meaning he incurred considerable costs. There is no evidence of fault by the Council other than its failure to keep full and clear records to show exactly what information it provided.
