Summary: Ms X complained the Council failed to provide suitable education or the provision set out in her two children’s, Child Y and Child Z’s Education, Health and Care Plans. Ms X could have complained to us sooner and there are no good reasons we should investigate this late complaint. We cannot investigate a complaint where someone has appealed to the tribunal about the same matter. The Council has already offered a suitable financial remedy for Child Y and Child Z’s lost provision and Ms X’s time and trouble which remedies the injustice caused so we have ended this investigation.

Summary: Mrs B says the Council failed to put in place education for her son, failed to identify a suitable school placement and failed to put in place provision in her son’s education, health and care plan. Part of the complaint is outside the Ombudsman’s jurisdiction. For that part within the Ombudsman’s jurisdiction there is evidence of failure to put in place sufficient education for Mrs B’s son, delay identifying a school placement and delay putting in place special educational needs provision. An apology, payment to Mrs B and reminder to officers is satisfactory remedy.

Summary: We uphold Ms X’s complaint about delay in amending her son Y’s Education, Health and Care plan, delay in considering her request for education other than at school and a failure to provide alternative provision. This caused avoidable distress, a delay in appeal rights and a loss of suitable education. The Council has agreed an apology and payments to remedy the injustice.

Summary: Mrs X complained about the Council’s consideration of her request for an Education Health and Care plan (EHC plan). She also complained the Council failed to provide her son with a full-time education while he was out of school. We found there was significant delay in issuing an EHC plan and Y did not receive a full-time education. We recommended an apology, and payments to recognise the impact of the fault we found.

It will also review relevant procedures, issue reminders to its staff, and ensure our findings are considered as part of its SEND Improvement Strategy.
