  • Adur District Council (22 016 319)

    Statement Upheld Noise 26-Jul-2023

Summary: Mrs X complained the Council has failed to properly investigate her complaints of noise nuisance or take appropriate or effective action to resolve the problem. There is no evidence of fault in the way the Council has attempted to gather evidence and witness the noise nuisance. There were however failings in its communication with Mrs X, for which the Council should apologise.

  • Adur District Council (23 000 200)

Statement Closed after initial enquiries Planning applications 25-Jul-2023

Summary: We will not investigate Mrs X’s complaint about land clearance done by a neighbour in 2022 near the rear of her and others’ property, how the Council dealt with a withdrawn planning application submitted by the neighbour to develop the land, and how the Council dealt with her contacts and complaint. There is not enough evidence of fault by the Council regarding the land clearance, nor injustice caused by the Council, to warrant investigation. We cannot achieve a different outcome on the Council’s handling of the withdrawn planning application. Mrs X’s claimed injustice during the planning process was caused by her neighbour, not the Council. We cannot achieve the outcome she seeks from her complaint. We do not investigate councils’ complaint‑handling and correspondence where we are not investigating the core issues giving rise to the complaint.

  • Adur District Council (23 003 909)

Statement Closed after initial enquiries Homelessness 05-Jul-2023

Summary: We will not investigate this complaint about the Council’s decision to place Miss X in temporary accommodation. This is because the complaint concerns events that took place more than 12 ago and there is no good reason to investigate events that took place this long ago.

  • Adur District Council (22 010 907)

Statement Not upheld Antisocial behaviour 08-Jun-2023

Summary: Mrs X complained the Council failed to take action in response to her concerns of anti-social behaviour from a neighbouring property which has caused her and her family significant distress. The Council was not at fault.

  • Adur District Council (23 002 363)

Statement Closed after initial enquiries Housing benefit and council tax benefit 08-Jun-2023

Summary: We cannot investigate this complaint about the Council’s housing authority’s failure to contact Universal Credit regarding Mr X’s tenancy. We have no jurisdiction to consider complaints about social housing landlords.

  • Adur District Council (22 016 977)

Statement Closed after initial enquiries Street furniture and lighting 28-Mar-2023

Summary: We will not investigate Mr X’s complaint about the Council allowing the installation of a communication firm’s cabinet next to the front wall of his house, and its refusal to fund its relocation. There is not enough evidence of fault by the Council in permitting the cabinet’s installation to warrant us investigating. Even if there were such fault, Mr X bought the house when the cabinet was already there. It was Mr X’s decision to buy the property which has directly resulted in his involvement in the situation causing him his claimed injustices. We also cannot achieve the outcome Mr X wants from his complaint.

  • Adur District Council (22 014 086)

Statement Closed after initial enquiries Enforcement 23-Jan-2023

Summary: We will not investigate this complaint about how the Council dealt with a breach of planning control. This is because we are unlikely to find fault.

  • Adur District Council (22 007 144)

    Statement Not upheld Enforcement 13-Jan-2023

Summary: Mr X complained the Council failed to take formal enforcement action against a developer who built his home. We did not investigate this complaint further as it was unlikely to result in a finding of fault or any other meaningful outcome.

  • Adur District Council (22 004 414)

Statement Closed after initial enquiries Planning applications 20-Dec-2022

Summary: We will not investigate this complaint about the Council’s pursuit of a project which the complainant says was bound to fail. The financial cost to the Council is something which affects all residents and is therefore outside our jurisdiction. Also, we do not consider the complainant has suffered a significant personal injustice which warrants our involvement. Finally, it is reasonable to expect the complainant to contact the Information Commissioner’s Office with his concerns about the Council’s refusal to provide information he requested.

  • Adur District Council (22 007 394)

Statement Closed after initial enquiries Licensing 05-Oct-2022

Summary: We will not investigate this complaint about information a Council officer provided to the Licencing Committee. This is because further investigation would not lead to a different outcome.
