  • Erewash Borough Council (22 003 145)

Statement Closed after initial enquiries Other 09-Jun-2022

Summary: We will not investigate this complaint about how the Council dealt with the complainant’s request for information. This is because this matter is best dealt with by the Information Commissioner’s Office.

  • Erewash Borough Council (21 014 583)

    Statement Upheld Enforcement 08-Jun-2022

Summary: The Ombudsman found fault by the Council on Mr and Mrs X’s complaint about it acting to ensure their neighbour cleared a site following a planning inspector’s dismissal of his appeal against the decision he was breaching planning consent. Its enforcement investigation was delayed, failed to keep them regularly updated about progress, and did not keep proper records. The agreed action remedies the injustice caused.

Statement Closed after initial enquiries Planning applications 28-Apr-2022

  • Erewash Borough Council (22 001 090)

Statement Closed after initial enquiries Building control 26-Apr-2022

Summary: We will not investigate this complaint that the Council wrongly approved defective building work which does not meet the building regulations. This is because an investigation would not achieve a meaningful outcome.

  • Erewash Borough Council (21 012 264)

Statement Closed after initial enquiries Enforcement 22-Dec-2021

Summary: We will not investigate this complaint about how the Council dealt with Mrs X’s neighbour’s extension. The neighbour’s extension was completed before Mrs X purchased her property so she has not been caused an injustice by the actions of the Council.

  • Erewash Borough Council (21 012 372)

Summary: We cannot investigate this complaint about how the Council dealt with the complainant’s planning application. This is because the complainant has used their right to appeal to the Planning Inspectorate.

  • Erewash Borough Council (21 011 441)

Statement Closed after initial enquiries Planning advice 09-Dec-2021

Summary: We will not investigate this complaint about the Council’s handling of the complainant’s tree works application. It is reasonable to expect the complainant to have used her right of appeal to the Planning Inspectorate to challenge the Council’s decision, and any injustice arising from the other alleged faults is not significant enough to justify the Ombudsman pursuing them further.

  • Erewash Borough Council (20 010 217)

    Statement Upheld Planning applications 30-Sep-2021

Summary: Mr and Mrs X complained about the Council’s assessment of a developer’s planning application to build a new house next door to their home. They also complained the Council failed to investigate alleged breaches of planning permission by the applicant. The Council accepted fault in the way it considered a neighbouring planning application, but the Ombudsman found no evidence the outcome would be different. The Ombudsman found there was a significant delay in the Council’s planning enforcement investigation. The Council agreed to provide a remedy.

  • Erewash Borough Council (21 004 559)

Statement Closed after initial enquiries Licensing 13-Aug-2021

Summary: We cannot investigate Mr X’s complaint about the Council’s handling of a taxi licensing matter. This is because Mr X has asked the court to consider the issue.

  • Erewash Borough Council (20 009 615)

    Statement Not upheld Covid-19 09-Aug-2021

Summary: Mr X complains the Council paid the Small Business Grant for his premises to the wrong person and that an officer made an unpleasant comment during a telephone call to discuss the situation. He says the loss of the grant has worsened his financial problems. There is no evidence of fault in the Council’s actions. It did consider whether the listing was inaccurate and whether to exercise its discretion to award the Small Business Grant to Mr X but was not persuaded by the evidence provided by Mr X. We are unable to take a view on the comment made by the officer as he denies saying it and there is no recording.
