Summary: Miss B complains of repeated failures by the Council to remove her household waste. She says the operatives do not always empty the wheeled bin completely and sometimes put other households’ waste in her bin before emptying. Sometimes she is left with waste in the bin and she considers the practice of putting other waste in her bin to be unhygienic. There was some fault in service provision which the Council responded to appropriately. Further investigation is not warranted.

Summary: A woman complained that the Council had unreasonably decided she was intentionally homeless and ended its housing duty in her case, despite her serious health problems. However the Ombudsman will not investigate this matter because the woman has statutory review and appeal rights she can use to challenge the Council’s decision.

Summary: Miss B complained the Council did not give her housing application the correct priority. Miss B says this resulted in her family living in unsuitable accommodation and she feared that her, and her children’s health would suffer because of this. New information became available during the investigation and the Council reviewed Miss B’s housing priority. The Ombudsman has discontinued the investigation as there is nothing more we can achieve.

Summary: Mrs D complains about lack of assistance and a failure to follow procedures by the Council in respect of her housing. The Ombudsman has found some evidence of fault, regarding the joint tenancy and a Tenancy Deposit Scheme claim) which has already been either acknowledged by the Council in its complaint responses or remedied because of this investigation. The Ombudsman has completed the investigation and upheld the complaint because there is fault. However, there is no further action required by the Council because there is no unremedied injustice.

There is no fault in the Council’s decision not to take enforcement action. The Council properly considered the impact of the extensions on Mrs X’s property and the surrounding area.
