The Ombudsman’s view is the Council’s decision was a reasonable one for it to make, based on the evidence available. So it is not one the Ombudsman can criticise.

    Summary: The Ombudsmen find there was an avoidable and unreasonable delay in arranging support for a man entitled to s117 aftercare. As a result he missed out on an opportunity to benefit from this support for close to a year. The fault also meant his mother incurred costs she would not have otherwise had, in attempting to provide replacement care. The NHS Trust has agreed to apologise, make payments and create an action plan to address the injustice these failings caused.

    Summary: Mr K is an adult with additional needs who receives care and support from the Council. There was fault in the way the Council carried out a financial assessment of Mr K and in its communications and its response to his complaint. The Council also failed to provide a care plan and personal budget. The Council has agreed to apologise to the family, to provide a care plan and personal budget, to reassess Mr K’s finances and to reimburse him accordingly. The Council has also agreed to pay a symbolic payment of £350 to reflect the injustice suffered by the fault.

I have completed my investigation on the basis that there was fault in the transition process. The Council has agreed to offer a financial remedy to the family.

    Summary: The Ombudsmen will not investigate Ms Z’s complaint about the funding arrangements for care of her mother, Mrs Y, who has complex needs. Ms Z says that disputes over funding between the Council and CCG delayed provision of appropriate care, and caused distress and anxiety to her and Mrs Y. The Ombudsmen should not investigate her complaint, as it is unlikely an investigation will be able to achieve anything further for her.

    Summary: Mrs X complains on behalf of her daughter, Y and states the Council has failed to arrange suitable provision to meet her special educational needs. She also complains it did not address her concerns about this matter in a timely manner, if at all, and it failed to ensure Y was properly safeguarded whilst at school. The Ombudsman has found the Council was at fault for failing to ensure suitable alternative educational provision was given to Y between December 2015 and April 2016. It was also at fault for not following statutory guidance and taking too long to transfer Y’s Statement of Special Educational Needs to an Education, Health and Care Plan. The Council’s faults resulted in Y losing educational provision therefore we recommend it makes a financial payment to her to remedy this injustice. We also recommend it apologises to her and her family for what happened. The Council has accepted our findings and will carry out our recommendations.

    Summary: Mr X complains about the way the Council handled a safeguarding referral made by the mother of his daughter’s boyfriend. He says the assessment it subsequently conducted failed to consider key evidence and neither his views nor those of his family were listened to. Similarly, he is concerned it did not properly investigate concerns he reported about his daughter’s welfare. The Ombudsman has found the Council was not at fault because its assessment took account of the evidence that was relevant to the case and focussed on the best interests of Mr X’s daughter. It also addressed the concerns he raised and found there was no risk to his daughter.
