  • Bournemouth, Christchurch and Poole Council (22 014 984)

Statement Upheld Special educational needs 03-Sep-2023

Summary: Miss X complained the Council delayed in assessing her child, B, for an Education, Health and Care (EHC) Plan. Miss X also complained the Council failed to confirm whether it would issue an EHC Plan to B within the statutory timescales and failed to communicate effectively. This caused avoidable frustration, distress, and uncertainty as to whether B had missed special educational provision. We have found the Council at fault. We have made recommendations to remedy the injustice caused.

  • Bournemouth, Christchurch and Poole Council (22 004 257)

Statement Upheld Refuse and recycling 28-Aug-2023

Summary: Mrs X complains that the Council failed to take sufficient action to deal with nuisance from commercial bins and failed to respond to her complaint. There is no evidence of fault in how the Council investigated Mrs X’s complaints about nuisance from the bins. The Council delayed in dealing with Mrs X’s complaint about insufficient action by the Council which put her to avoidable time and trouble and caused distress to her. The Council has agreed to remedy this injustice by sending a written apology to Mrs X and making a symbolic payment of £200 to her.

  • Bournemouth, Christchurch and Poole Council (22 014 457)

    Statement Upheld Child protection 28-Aug-2023

Summary: Ms X complained the Council failed to take action when she was groomed and sexually exploited as a child in its care, allowed her to remain in inappropriate placements and breached her confidentiality causing her to suffer from PTSD and live in fear of being tracked down by a family member. This investigation did not reinvestigate the issues that were appropriately investigated through the Statutory Children’s Complaints Procedure. We are recommending a payment in respect of the delay in moving Ms X from the kinship placement in 2009.

This caused avoidable time and trouble and a loss of provision. The Council will apologise, make Ms X a symbolic payment and arrange and pay for the six hours weekly tuition Ms Y missed out on in the school year 2022-2023.

  • Bournemouth, Christchurch and Poole Council (22 007 502)

Statement Upheld Special educational needs 15-Aug-2023

Summary: Miss Y complains the Council delayed in completing the annual review of her child, Z’s Education, Health and Care Plan and delayed in consulting suitable alternative placements. We find that the Council delayed by over a year in sending Miss Y the final Plan causing Miss Y distress and denying her appeal rights to the Tribunal. The Council has agreed to apologise to Miss Y, make her a symbolic payment and make several service improvements. The Council had previously accepted it failed to accurately and promptly communicate decisions to Miss Y. We find the Council has already suitably remedied the injustice caused by this fault.
