    Summary: Mrs X complained about the Council’s actions to support the educational needs of her son Y from September 2018. We find the Council was at fault for a delay in issuing Y’s Education Health and Care plan and for failing to consider whether he needed alternative provision when he stopped attending school because of anxiety. That caused Mrs X avoidable distress and meant Y went a short period without suitable education. The Council has agreed to apologise to Mrs X and make a payment to remedy any injustice caused.

    Summary: Mr and Mrs B complained about the Council updating their daughter’s EHCP following a decision by the tribunal and delay in making the provision. There was fault by the Council which caused injustice to Mr and Mrs B and their daughter. The Council will remedy this by apologising and making a payment.

    Summary: We found fault with the support a Trust provided to a man with complex care needs and his parents. We also found fault by a Council in terms of the handling of the Mental Health Act Assessment process by an Approved Mental Health Practitioner acting on its behalf. The Council and Trust will apologise to the complainants and pay a financial sum in recognition of the distress caused to them by this fault. They will also take action to prevent similar problems occurring in future.

    Summary: There was no fault by the Council in the way it assessed Mr B’s care and support needs, carried out safeguarding enquiries, sought suitable accommodation for Mr B or considered his disability. However, on one occasion it failed to provide Mr B with accommodation when he had nowhere to stay and so he had to sleep in his car. The Council has agreed to apologise to Mr B and to take action to prevent similar failings in future.

    Summary: Mr and Mrs E complained about the Council’s delays in dealing with their son’s Education, Health and Care plan. They also complained about the Council’s communication with them. We find the Council delayed dealing with Mr and Mrs E’s son’s Education, Health and Care plan and delayed providing him with alternative and specialist provision. The Council also failed to update Mr and Mrs E and delayed responding to their correspondence. The Council has agreed to our recommendations to address the injustice caused.

The Ombudsman finds there was avoidable delay, missed provision for D and time and trouble caused to Mrs X in chasing this up. We have made recommendations for an apology, financial remedy and service improvements.

    Summary: Mr A complains the Council has delayed issuing an Education, Health and Care Plan for his son, C, and so he has lost out on support that should have been provided. The Ombudsman finds fault with the Council for delaying reviewing and issuing the Plan for 19 months. The Ombudsman also finds fault with the Council for failing to provide information from the Plan, failing to consider the request for a personal budget, and for poor complaint handling. The Council has agreed to make a payment in recognition of lost provision, and for the distress caused to Mr A. The Council will also review how it monitors annual reviews and requests for personal budgets.

    Summary: Mrs B complains the Council has not dealt with her daughter Miss X’s Special Educational Needs properly. The Council did not follow statutory timescales, did not obtain reports in time and did not deal with Mrs B safeguarding complaint properly. Mrs B incurred costs to obtain independent reports, did not receive a proper response to her complaint about safeguarding and suffered distress. Miss X’s right to appeal was delayed and she missed support. The Council has agreed to apologise to Mrs B, pay Mrs B £200 for her time, trouble and avoidable distress, pay Mrs B £600 for the delay and Miss X’s missed provision and £1050 for the independent reports she had to provide and review how SEND assessments requests are communicated and actioned.

    Summary: Ms X complained about the Council’s actions in relation to her son, Z’s, Education, Health and Care (EHC) Plan. She also complained the Council delayed carrying out an assessment to determine if Z and his sibling were children in need. The Council was at fault when it delayed finalising Z’s EHC Plan, did not issue an amendment notification after his annual review and did not provide all the support in his Plan. The Council should make Ms X a payment to acknowledge the injustice this caused her and Z. The Council was at fault when it delayed in carrying out a child in need assessment, but this did not cause Ms X an injustice.
