  • Sheffield City Council (23 009 083)

Statement Closed after initial enquiries Trees 12-Sep-2023

Summary: We will not investigate Mr B’s complaint that his property was damaged by a fallen tree. This is because it is reasonable for Mr B to pursue his compensation claim by taking the Council to court.

  • Sheffield City Council (23 005 945)

Statement Closed after initial enquiries Special educational needs 10-Sep-2023

Summary: We will not investigate this complaint that the Council refused to consider a complaint. This is because there is insufficient evidence of fault by the Council. Complaints about how the Council has responded to a Freedom of Information request is better dealt with by the Information commissioner and we cannot investigate matters previously considered by the Ombudsman.

  • Sheffield City Council (23 003 453)

Statement Upheld Street furniture and lighting 29-Aug-2023

Summary: There was fault by the Council in its measurement of light levels. Either it measured light at the wrong property or it made an error in one of the complaint responses by referring to the wrong house number. Either way, this was fault causing avoidable confusion about whether the measurements were from the right property. The Council has already taken appropriate action to remedy the injustice by retaking measurements and undertaking repairs to the lamp’s shield.

  • Sheffield City Council (23 003 611)

Statement Closed after initial enquiries Housing benefit and council tax benefit 29-Aug-2023

Summary: We will not investigate this complaint about the Council’s decision to refuse a discretionary housing payment application as it is unlikely we would find fault by the Council.

  • Sheffield City Council (22 015 298)

Statement Upheld Special educational needs 29-Aug-2023

Summary: There is no evidence a delay in arranging a school placement for a child with an education, health and care plan was due to fault by the Council; and nor can we say any omission by the Council was responsible for a subsequent deterioration in the child’s behaviour, which led to his exclusion. We are unable to investigate a complaint about the alternative provision subsequently offered to the child, because it is linked to a matter which carried a right of appeal. There was some fault by the Council in its handling of the independent review against the child’s exclusion, for which it has agreed to apologise and circulate guidance to staff.
