Summary: Mrs X complained about the Council’s failure to carry out an Education, Health and Care (EHC) needs assessment for Y when she had asked for it in January 2022, follow the statutory timescales for an EHC Plan process and deliver suitable full-time education to Y since September 2022.

  • Essex County Council (23 012 630)

Statement Upheld Special educational needs 06-Mar-2024

Summary: The Council delayed carrying out an Education, Health, and Care Needs Assessment for Ms X’s child, Z. This was due to the shortage of Educational Psychologists. We are satisfied with the service improvements already being carried out by the Council to resolve this issue. However in recognition of the injustice caused to Z and their family, the Council has also agreed to pay Ms X £100 for each month of delay in concluding Z’s needs assessment.

  • Essex County Council (23 011 983)

Statement Upheld Special educational needs 06-Mar-2024

Summary: There was a sixteen week delay in the Council issuing an amended final EHC Plan after an annual review meeting. There was also a failure to resolve the complaint at local level. This caused injustice. The Council will apologise, make a symbolic payment and consider service improvements.

  • Essex County Council (23 016 413)

Statement Closed after initial enquiries School transport 05-Mar-2024

Summary: We will not investigate Mrs X’s complaint about the Council’s decision to change a named home to school transport provider for a child she cares for because there is insufficient evidence of fault, and we cannot achieve the outcome Mrs X wants.

  • Essex County Council (23 015 715)

Statement Closed after initial enquiries Special educational needs 04-Mar-2024

Summary: We will not investigate Mr X’s complaint about delay after the annual reviews of his children’s Education Health and Care Plans. This is because the delay did not cause a personal injustice significant enough to warrant investigation. If Mr X wants to challenge the content of his children’s Education Health and Care Plans, he now has a right of appeal to a tribunal.

Statement Upheld Special educational needs 04-Mar-2024

Summary: We will not investigate Mr X’s complaint about delays in the Education Health and Care Plan process. This is because the Council has agreed to an appropriate remedy for the delay.

  • Essex County Council (23 010 582)

Statement Upheld Special educational needs 26-Feb-2024

Summary: Mr X complained the Council named an unsuitable school in his daughter, F’s Education, Health and Care (EHC) Plan following an annual review, failed to respond to his request for a re-assessment of F’s needs and did not respond to his mediation request. The Council was at fault. It did not respond to Mr X’s request for an EHC needs re-assessment. It then took six months to respond to his complaint about mediation. The Council agreed to apologise and make a symbolic payment to Mr X to recognise the distress and uncertainty caused. It will also consider whether to carry out an EHC needs re-assessment without further delay.

  • Essex County Council (23 001 035)

Statement Upheld Special educational needs 22-Feb-2024

Summary: Ms X complained the Council did not respond to her request for a Personal Budget, meaning her child did not receive tutoring and support he should have. There was some fault by the Council in the way it communicated with Ms X about her request to use additional funding as a Personal Budget, however this did not cause her significant injustice. We have not investigated Ms X’s other complaints about delays in issuing a final Education, Health and Care plan as we previously agreed a remedy for any injustice this caused. We cannot investigate Ms X’s complaint about the content of the latest Education, Health and Care plan the Council issued as Ms X has appeal rights to the First-tier Tribunal (Special Educational Needs and Disability) which she has exercised.
