The Council says it followed government guidance and took into consideration the view of a suitably qualified healthcare professional. We find the Council acted without fault.

    Summary: Mr X complains the Council failed to properly assess his application for a Blue Badge. He says the Council’s handling of his application caused him distress and inconvenience. The Ombudsman finds the Council at fault for the way it explained its decision to Mr X and for failing to have an appeals process. To remedy the injustice this caused Mr X, the Council has agreed to apologise and make Mr X a payment for the distress and uncertainty. It has also introduced service improvements, including a Blue Badge review process.

    Summary: Mrs X complained about the Council refusing her application to carry out pruning work on a neighbour’s tree which is protected by a preservation order (TPO). We should not exercise discretion investigate this complaint. This is because it was reasonable for her to appeal to the Planning Inspectorate which is the proper authority to consider appeals about TPO decisions.

    Summary: Mrs X complained that the Council failed to recognise it had a duty to provide alternative education for her son when he was out of school for health reasons and failed to ensure he received the support set out in his Education Health and Care Plan. The Council was at fault in failing to recognise its duties, failing to have proper policies and procedures in place, and failing to provide education. The Council has offered a suitable remedy including an apology, a payment for lost education and a review of policies and procedures.

    Summary: Mr X complains about the information the Council provided about the upgrades of streetlights to LED lights. He says the Council misled him and did not tell him the lighting system would use the existing 3G/4G network to operate. He also complains the lamppost was still sending out wireless signals despite the Council removing the wireless transmitter. The Ombudsman does not find fault with the Council’s actions.
