    Summary: Mr B complained the Council discharged his father in to his and his mother’s care despite them not agreeing to care for him. He said this put his mother at risk of harm from abuse and physical injury. He complained the Council did not provide support or respite. He said caring for his father meant he had to give up his job and negatively impacted his well-being. The Council apologised for its delay arranging to review Mr B’s carers assessment. We found no other fault by the Council and consider its apology a suitable remedy for the injustice to Mr B and Mrs C by its delay.

    Summary: Miss X complains on behalf of her son, B, about the Council’s response to concerns raised about B’s care and support. Ms X also complains the Council failed to complete actions agreed as part of its complaints procedure. We have found fault with some of the Council’s actions. We have made recommendations to remedy the injustice caused. We have not found the Council at fault for not having a specific strategy for internet safety. We have not investigated whether the compensation already offered by the Council is suitable. The upcoming multiagency investigation is better placed to consider this part of Miss X’s complaint.

    Summary: We will not investigate Mr X’s complaint about a court report and the conduct of the social worker involved in Mr X’s case. This is because we cannot investigate complaints about what happened in court. This includes the content of court reports. The actions of the social worker are not separable from the report. Also, we cannot achieve the outcomes Mr X wants.

    Summary: Mrs X complained the Council failed to provide suitable transport to and from school for her child. We found fault with the Council failing to provide suitable transport. The Council agreed to our recommendations to provide an apology to Y and pay Mrs X £300, for Y’s benefit, for the missed education, stress and difficulty Y experienced.

    Summary: Mrs X complained the Council failed to ensure the provision set out in her son, Y’s Education, Health and Care plan was delivered and failed to adequately support his transition to post 16 education. The Council was at fault for failings in the annual review process in December 2021, not issuing a final amended plan for Y by 31 March 2021, missed provision in 2021-22, for delays in transition planning and support, poor communication and poor complaints handling. The Council should apologise and make payments to reflect the injustice caused to Y by the missed provision, the uncertainty and frustration caused to Mrs X, and the avoidable time and trouble she was put to pursuing the Council.

    Summary: The Council failed to act in 2019 when it became aware that Mr X’s grandson’s school could no longer meet his needs. It delayed in consulting with possible suitable placements and failed to arrange suitable alternative provision when the child could not attend school. The Council also delayed in issuing an amended education, health and care plan following the annual review in October 2020 and failed to issue a final plan. In recognition of the injustice caused, the Council has agreed to issue a final EHCP and provide the child with suitable alternative education until it secures a new placement for him. It has also agreed to make a payment to Mr X.

    Summary: We will not investigate Mr C’s complaint about the Council’s decision to treat his mother’s, Mrs D’s, gifts of money from the sale of her property as a deprivation of asset. This is because it is unlikely we would find enough evidence of fault with the actions taken by the Council to warrant an ombudsman investigation.

    Summary: Mrs C complained how the Council handled a review of her brother’s, Mr E, care and support needs. She says the process took 19 months and the Council’s communication was poor. She also complained her mother’s, Mrs D, carer’s assessment was poor and the Council’s handling of Mr E’s direct payments was unreasonable. We find the Council was at fault for its communication and its lack of timely updates when dealing with Mr E’s review. It was also at fault for its handling of Mrs D’s carer’s assessment and for the way it handled Mr E’s urgent toileting needs. The Council has agreed to our recommendations to address the injustice caused by fault.

    Summary: Mrs B complained the Council failed to include all medical recommendations in her daughter’s education, health and care plan and failed to quantify the provision in the plan. The Ombudsman will not investigate this complaint as Mrs B has a right of appeal to tribunal.
