We found the Council delayed in completing the re-assessment. It has offered a satisfactory remedy for the injustice caused by this. The Council was not at fault in failing to request an assessment by an educational psychologist, but it has now agreed to do so.

    Summary: Mrs Y complains that the Council failed to ensure her daughter, X, received the education she was entitled to as per the provision named in her Education Health and Care Plan. In our view, X has received up to nine hours per week as specified in the amended draft plan. However, the Council has not issued a final plan, and this has frustrated Mrs Y’s right of appeal to challenge this. The Council has agreed to apologise, pay £300 and undertake the service improvements listed at the end of this statement.

    Summary: Mr R said the Council was at fault for failures in its care for his stepson Mr C. He also complained about poor communication. The Council was at fault for failures in its care for Mr C and its communication with Mr and Mrs R. These failures caused injustice to Mr C who became unwell after a failure to give him prescribed medication and to Mr and Mrs R who were excluded from discussions about Mr C’s care. The Council has agreed to pay Mr and Mrs R a sum in recognition of their distress and to investigate the standard of care at a care facility where Mr C lived.

There was fault causing injustice when the Council failed to adequately communicate with Ms X or involve her in its initial decision-making. The Council’s apology and improvements since Ms X’s complaint remedies her injustice.
