    Summary: Mr X complained that the Council delayed in completing an education, health and care needs assessment for his daughter, C, and in issuing an accurate final education, health and care plan. He also says the Council delayed in securing alternative provision for C and failed to provide a personal budget. We found the Council was at fault in that it delayed in issuing a final accurate plan and delayed in securing alternative provision for C. In recognition of the injustice caused, the Council has agreed to apologise and make a payment to remedy C’s loss of education provision and to acknowledge the distress, frustration and uncertainty Mr and Mrs X suffered.

    Summary: Mrs X complains about the way the Council has dealt with her concerns about her child’s (Child Y) education. The Council was at fault for not acting sooner to secure an alternative placement for Child Y for over two years and for not ensuring Child Y received the provision set out in their Education, Health and Care Plan (EHCP). The Council has agreed to apologise and make payments to Child Y and Mrs X for the missed education provision and poor handling of Mrs X’s complaint.

We found fault with the Council for failing to complete a suitable review of Ms X’s care needs and delays in providing direct payments. The Council agreed to our recommendation to backdate Ms X’s care fees for her missed therapy support, apologise to Ms X and pay her £300 for the distress and inconvenience caused. The Council also agreed to provide training to staff about the importance of accurate record keeping.
