  • Suffolk County Council (23 008 102)

    Statement Upheld Charging 08-Mar-2024

Summary: Miss X complained about the Council’s decision to charge her for care and support, and for backdating the charges, despite earlier telling her she would not have to pay. We found the Council at fault for delays in the re-assessment process, for failing to properly explain its decision, and for failing to acknowledge Miss X’s evidence and vulnerability.

  • Suffolk County Council (23 016 415)

Statement Closed after initial enquiries Child protection 05-Mar-2024

Summary: We will not investigate this complaint about the Council’s involvement with the complainant’s family. This is because we cannot consider complaints about matters that were or could be raised in court.

  • Suffolk County Council (23 016 757)

Statement Closed after initial enquiries Other 05-Mar-2024

Summary: We will not investigate this complaint about a data protection breach because the Information Commissioner’s Office is better placed to consider the complaint.

  • Suffolk County Council (23 015 001)

Statement Closed after initial enquiries Special educational needs 20-Feb-2024

Summary: We will not investigate this complaint about the Council has failed to make appropriate educational provision for a child. This is because it is reasonable for the complainant to use their right of appeal to a tribunal.

  • Suffolk County Council (23 004 587)

Statement Upheld Assessment and care plan 20-Feb-2024

Summary: Ms C complains the Council failed to properly assess her needs, provide services, and support her to move into independent living. The Council is at fault for failing to reassess Ms C when there was a change in circumstances, raise her expectations about services it would provide, and support her through a transition period. To remedy the complaint the Council has agreed to apologise to Ms C and make her a symbolic payment. It will also remind staff about the need to review needs when there is a change in circumstances.

  • Suffolk County Council (23 015 794)

Statement Closed after initial enquiries Child protection 19-Feb-2024

Summary: We will not investigate this complaint about the care of a child. This is because the complaint is made late, and I see no good reason why it could not have been made sooner. The courts are better placed to consider if there has been a breach of a care order.

  • Suffolk County Council (23 015 460)

Statement Closed after initial enquiries Other 15-Feb-2024

Summary: We will not investigate Mrs X’s complaint about a children services’ assessment form. It is reasonable to expect Mrs X to get in touch with the officer contact the Council gave her and we are unlikely to achieve more.

  • Suffolk County Council (23 013 946)

Statement Closed after initial enquiries Transport 14-Feb-2024

Summary: We will not investigate this complaint about the Council’s refusal to issue a blue badge. There is not enough evidence of fault in how the Council made its decision to justify investigating.

  • Suffolk County Council (23 005 407)

Statement Not upheld Special educational needs 13-Feb-2024

Summary: Ms X complained the Council failed to provide suitable education or the provision set out in her two children’s, Child Y and Child Z’s Education, Health and Care Plans. Ms X could have complained to us sooner and there are no good reasons we should investigate this late complaint. We cannot investigate a complaint where someone has appealed to the tribunal about the same matter. The Council has already offered a suitable financial remedy for Child Y and Child Z’s lost provision and Ms X’s time and trouble which remedies the injustice caused so we have ended this investigation.

  • Suffolk County Council (23 005 229)

Statement Upheld Special educational needs 08-Feb-2024

Summary: Mrs B says the Council failed to put in place education for her son, failed to identify a suitable school placement and failed to put in place provision in her son’s education, health and care plan. Part of the complaint is outside the Ombudsman’s jurisdiction. For that part within the Ombudsman’s jurisdiction there is evidence of failure to put in place sufficient education for Mrs B’s son, delay identifying a school placement and delay putting in place special educational needs provision. An apology, payment to Mrs B and reminder to officers is satisfactory remedy.
