  • North Lincolnshire Council (19 010 441)

Statement Not upheld Child protection 07-Sep-2020

Summary: Ms X complains the Council failed to provide adequate help when her children were on a child protection plan and did not deal with her complaints correctly. I have discontinued my investigation on the basis that X’s complaints are premature as they are still being investigated by the Council.

  • North Lincolnshire Council (20 002 122)

Statement Closed after initial enquiries Other 07-Sep-2020

Summary: The Ombudsman will not investigate this complaint about a request for information because there is another body better placed to consider it. Complaints about data matters are best considered by the Information Commissioner.

  • North Lincolnshire Council (20 001 445)

Statement Closed after initial enquiries School admissions 27-Aug-2020

Summary: The Ombudsman does not have reason to investigate this complaint from a parent about the school admission appeal panel’s decision to turn down her appeal regarding a school place for her son. This is because there is no sign of fault in the appeal arrangements or the way the panel made its decision.

  • North Lincolnshire Council (19 008 400)

Statement Upheld Assessment and care plan 14-Aug-2020

Summary: The Council is at fault as it delayed in completing a Care Act assessment and care and support planning for Mr X. As a result, Mr X had to live in a care home for six months longer than necessary which caused significant distress to Mr and Mrs X. The Council has agreed to remedy this injustice by making a payment of £1000 to Mr and Mrs X to acknowledge the distress caused to them.

  • North Lincolnshire Council (20 001 012)

Statement Closed after initial enquiries Other 10-Aug-2020

Summary: The Ombudsman will not investigate Mr X’s complaint about the Council failing to follow a doctor’s recommendation in 2001. There are no good reasons why the late complaint rule should not apply.

  • North Lincolnshire Council (20 001 615)

    Statement Upheld Planning advice 07-Aug-2020

Summary: The Ombudsman will not investigate Mrs X’s complaint about the Council’s failure to respond to her pre-application planning enquiry. This is because the Council has provided a suitable remedy for the complaint.

  • North Lincolnshire Council (20 000 928)

Statement Closed after initial enquiries Planning applications 04-Aug-2020

Summary: The Ombudsman will not investigate this complaint about delay in determining the complainant’s planning applications. The complainant had a right of appeal to a Minister and could seek a remedy in court

  • North Lincolnshire Council (19 021 143)

Statement Closed after initial enquiries Other 01-May-2020

Summary: The Ombudsman will not investigate Mr X’s complaint about the Council’s 2017 decision to grant a Certificate of Lawful Development to a nearby industrial site. The complaint is late. There is not enough evidence of Council fault to justify an Ombudsman investigation of the matter now. Mr X can submit to the Council any evidence he has about the site’s certification which he considers should result in different decision, and it would be reasonable to ask the courts to decide any question of the Council’s interpretation of planning law relevant to the site.

  • North Lincolnshire Council (18 013 579)

Statement Upheld Assessment and care plan 13-Mar-2020

Summary: The Ombudsmen find fault by the Trust, in that it sent Mr M’s follow-up appointment letters to the wrong address and as a result he was discharged from follow-up care. This meant Mr M did not have the opportunity to discuss his care with a specialist. However the Ombudsmen find it was reasonable of the Trust and Council not to refer Mr M for continuing healthcare, and that he was provided with stroke rehabilitation in line with the relevant standards and guidance.

  • North Lincolnshire Council (19 018 929)

Statement Closed after initial enquiries Highway repair and maintenance 10-Mar-2020

Summary: The Ombudsman will not investigate Mr X’s complaint about how the Council has dealt with his claim for compensation after his car was damaged by a pothole. It is reasonable to expect Mr X to take court action for the compensation he seeks, and the complaint is therefore outside the Ombudsman’s legal remit.
