    Summary: Ms X complained the Council failed to follow statutory guidance and its own policies when it held an Initial Child Protection Conference regarding her child, Y. The Council was at fault for failing to provide Ms X with all the reports for the conference. There was also fault in the Council’s record keeping. The Council has already apologised for the faults, and this was sufficient to remedy any injustice caused.

    Summary: Mr X complained the Council delayed carrying out a financial assessment for his mother Mrs Y’s contribution to her care costs and then wrongly decided his mother has deprived herself of assets to avoid care costs. There was no fault in the way the Council decided Mrs Y had deprived herself of assets. Through its complaints investigation the Council identified faults with its initial decision making regarding deprivation, delay in the financial assessment process and in information provided to the family. It offered to apologise and pay Mr X £250 which was appropriate. It also agreed to take action to prevent recurrence of the faults.

    Summary: There was fault the Council delayed issuing an Education, Health, and Care plan for Mrs X’s son. Those delays caused an injustice to Mrs X because of uncertainty about her son’s education. The Council has already apologised for those delays. There was also fault the Council did not do enough to consider its duty to ensure Mrs X’s son was being provided education provision, while he was out of school, and this fault has caused Mrs X’s son an injustice. During our enquiries, the Council made a suitable offer of a financial remedy to recognise these injustices.
